I need an advise. My family owns a small company and we know that all emplyees are required to become an SSS member and their salary will be deducted for the contributions. But the employees are not willing to pay the contributions. Is it possible to change their status to a VOLUNTARY MEMBERS even if they are employed? How can we protect ourselves from future benefits claims that their family thought they are entitled to even if they are not paying their SSS contributions?

Well. What do the employees say about the law say SSS, PhilHealth and Pag-Ibig HAVE TO be paid?
How can they stop it? The employer HAVE TO deduct their share of the fees BEFORE paying them the rest.

It's very SHORT thinking of them to be against it, because YOU will pay around HALF for THEIR insurances... Smile

Changing the SSS status to voluntary is illegal because there is an employer share which means the employees will get lesser pension upon retirement ergo it is prejudicial to the workers. Your company might be the subject of a routine inspection by the SSS or DOLE will discover this. Violation of SSS law is criminal in nature. Better explain to the workers the requirement of the law on this as well as its benefits to them.

hi atty! i logged in on my sss website and it seems like my prev employer did not remit my 4 months contribution., unfortunately i failed to print out my payslip,i only have my id and a certification that i completed my training. i was denied for my sickness benefits because of that.
please help... 😭😭😭

Go to SSS, verify and report unpaid contributions so they can notify and demand payment from employer. If the employer refuses to pay, criminal case may be filed against them by the SSS.

If the employer haven't paid SSS, then he has probably haven't paid the other obligatotic PhilHealth and Pag-Ibig either
perhaps not even forwarded the income tax deducted from your salary,
