Hi. Thank you for the interest in responding. Both of us are Filipino nationals, both working overseas at that time, to be specific, in Dubai. We were married 2 years ago and now would like to file for separation. We're still not in good terms for over a year now. So when he came back here in the Philippines, we decided not to register the marriage due to never ending conflicts. Are we still considered married only in Dubai or in both countries? Should be divorce or annulment?

How do you know that your marriage is not recorded here in the Philippines? Did you try requesting for a copy of your marriage contract with the NSO or your CENOMAR (Certificate of No Marriage) and you appeared as single?

Please know that since you and your husband are both Filipino citizens at the time of the marriage celebration, even if you get a divorce while still a Filipino citizen, you will remain married here in the Philippines. What you should file is Annulment of marriage or Nullity of Marriage, depending on the grounds available to you.
