nagtatarabo po ako sa isang call center for 2 yrs. I got pregnant last June 2015 I am having problem with pregnancy coz Sobra yun pagsusuka ko at pagkahilo.. nag absent ako sa work pero i presented med cert.. though hindi po credited ng office yun ob kasi di covered po yun panganganak ang covered lang po ay check up. tas ang ospital lang po is medical city. Nag pacheck up po ako sa Ob na di credited ng health card syempre ang kelangan pong hahawak sayo pag nanganganak ka is yung ob mo alam ang history mo. ang sabi po ng OB yun paglilihi tatagal po ng 5 months. so ginawa ko po weekly po yun binigay kong medcert para if ok po yun pakiramdam ko makakapasok po ako. Nun una po okay lang sa kanila nun mga isang linggo. 2nd week po hinharass na nila ko di raw valid yun medcert di raw pwedeng puro med cert kasi nakatengga daw po yun trabaho ko. dapat daw matagal na ko tanggal sa ginagagwa ko. sobrang na demoralize po ako.. tas di na po sila nag rereply sa mga notifications ko. october 1 po pumunta ako office sinervan po nila ako ng NTE due to excess absences I submitted them naman po yun response ko sa NTE nun oct 6. then they said they are just going to call me daw po. ang satus ko po sa office is AWOL.. nag antay po ako pero sinabihan pa po ako ng hR na di ka pwedeng 1 year mawawala you have to decide now this is a business.. umabot na po nang nOv 26 wala pa po resolusyon. Nag file po ako sa NLRC ng constructive dismissal kasi hinold din po nila yun 13 month pay ko. nag hearing po kami sa Sena nun january 13, gusto po nila bumalik ako pero ayoko na po after nun ginawa nila. nag karoon po ako ng depression.. emotional stress. sinabi ko po yun demands ko na tas nag hearing na po kami ulit January 20th nag 2nd hearing kame ang babayaran lang daw po nila is 30k kasama na po yun separation pay, sick leave 13 mo ko. nag set po ulit ng hearing ang SEna sa FEB 10 for settlement na daw po. pwede ko naman po hindi tanggapin yun offer ng company and ituloy na yun demanda? kelangan ko na po ba ng lawyer and malakas po yun kaso? There really is a constructive dismissal present. But you also have done something wrong. what you should have done, is file a leave for 5 months knowing that your pregnancy sickness is for that duration. And not that weekly presentation of medical certificate if your not feeling well. Your HR was i guest not competent enough, if it were a knowledgeable HR, your situation is different. If your reason is about monetary award, then just compute honestly what you actually earn and bargain yourself in the settlement.

You can always not accept the settlement, but your case would drag-on for a longer time, and i doubt they would prefer the salary reinstatement. Just bargain what you think you really earn with them if i were you
