Now po I have Rfi (reason for investigation) 1 at pending 2.and 3 also because of performance. Nakipag usap po ako last monday sa HR kasi hiningian nila.ko ng second letter para daw ipahayag ko side ko so I asked them if ano na mangyayare sakin ang sabi ng Hr eh dahil rfi 3.nako d.na.daw ako pde sa force resignation at for termination na daw.ako at hinihintay na lang nila yung evaluation day which is like judgement day na for me. Binigyan ako ng advice na mas maige na unahan ko na at mag resign na ko kesa maiterminate ako base sa stats ko. Pwede po ba nila ako iterminate dahil sa.performance ko? Qualified po ba tong issue ko sa constructive termination? please help po kasi nakakademotivate na ang ginawa nila. Thank you po.
1. If it is included in your contract and the policy/COC, and you are AWARE of it. It is justifiable.
2. If they can provide a proof like KPI's, monthly metrics, evaluation forms, feedbacks and others, (with your signature of course and you are aware of it) and it is evident that you are not reaching the said quota/rating they can do it (provided that poor performance is included in the COC)
3. They can only terminate you if they do "due process". I suggest you study the process of termination in your company.
