Ang problema ko po ay yung lot property sa likod namin na kapareho ng size ng lot property namin. So front nila at likod na boundary namin ang problema. Kung bibigyan po sila ng right-of-way, gaano po kalapad ang minimum at kaninong property po ibabawas? Ayaw naman po naming awayin dahil kamag-anaak namin sila. Please advise, Thank you very much.

Yung size depende sa usapan nyo, may iba kasi na gusto maka daan lang ang tao, yunh iba naman, makadaan ang sasakyan. mas maigi na pagusapan nyo yung size.
Our laws provide that yung property for right of way ay ibabawas servient state. In your case, kayo po yung servient state, But I will suggest na hati na lang kayo sa pagbawas ng property para maging road right of way para fair.

Salamat po.
Nagpunta po kasi sa City Assessor's Office.
Napag-alaman po naming may R.O.W. pala sa lote ng kapatid nilang katabi.
Samakatuwid, di na kami required mag-allot ng portion ng lote namin.

Ang problema naman po, ayaw nila kaming harapin sa Barangay Hall. Ang gusto eh demandahan. Pwede po ba silang mag-demanda kahit di dadaan muna sa usapang Barangay? Di po ba magastos at matagal ang court proceedings? Eh kailangang-kailangan na po naming ipagawa agad yung bahay namin bago mag-tag-ulan at bago maubos ang pampagawa namin. Paano po ba ang magandang gawin?

U really need to hire a lawyer for that. Madali lang naman yang case na gĂ nyan kung may documents naman kau na nagpapatunay na may right of way na sila sa iba. Ang daanan ay hindi automatic right of way yan. Nagiging right lang yan kung wala talagang madaanan. Pwede naman silang humingi sa inyo ng daanan pero dapat bayaran nila or magmonthly pay sila.

Mostly talaga dyan, di sisipot sa brgy yan kaya pwede na yan ifile sa korte.

Pero sabi po nila napakatagal at magastos ang proseso sa korte.
Kaming nagre-reklamo pero di naman mapera, pwede po ba kaming bigyan ng korte ng pro-bono na abogado?

May abogado na walang bayad, sa Public Attorney's Office. Gobyerno ang nagbabayad sa kanila.
