Gusto ko lang po malaman kung pwede ko ba kasuhan yung previous company namin na kinaltasan ako ng para sa headset kahit naibalik ko naman? naibalik ko kasi sya after 5days ng separation date ko, eh policy daw nila na no more than 2days ang submission ng headset kapag naterminate ka or nagresign.
Isa pa po sa concern ko is naterminate kasi ako dahil nagka UTI ako, may policy kasi sila na maximum of 8hrs lost shift lang ang tolerable pag nasa training ka pa, eh nagkasakit ako ng UTI, may med cert ako pero hindi nila i-honor kasi nga daw hind daw sya same date nung nagkasakit ako. Parang 21st ako nagkasakit at nagpacheck up, tapos 24th ng buwan ako naterminate, so hindi pa din daw valid yun. Nakipagpalitan ako ng e-mail sa kanila pero policy daw yun at yun daw ang sagot ng IT Director. Saan ko po sila kakasuhan at anong kaso po?

Sa pera na kinaltas sayo e pwede mong ireklamo yan.

Nasabi mong nasa training ka pa. I presume na Trainee ka pa lang. In this case, I think na-terminate ka on the basis of 'failed training'. If this is the case, then wala kang rason para magsampa ng kaso kasi legal ang ginawa nila.

Ang question ko po is pwede ko ba sila sampahan ng kaso dahil sa pagdeduct nila sa headset ko na ibinalik ko naman?

Kinaltasan kasi ako ng 3,500 sa backpay ko dahil sa "Late Submission" ng headset ko which is understandable sana kasi po nagkasakit nga ako. Naibalik ko naman sya after 5days ng separation ko sa company, yun yung time na magaling na ako. Hindi ko naman po hinahabol yung employment ko sa kanila, yung pera lang. Kasi parang unfair, ang alam ko po nagkakaltas lang pag nasira mo o hindi naibalik yung gamit. Sa case ko inacknowledge pa nila na nareceive nila yung headset.

If there is an agreement/contract and If you are aware right from the start that trainees are not allowed to have absences or even issues with punctuality, and you signed it, they are allowed to terminate your contract (Provided there is a due process, like termination of trainee status, letter of non continuance for trainees).

For the headset they provided you. If you were able to return it, they have no right to deduct whatever amount sa back pay mo, if you have proof na naibalik mo.
