Hi po. My concern po kc ako. Hindi na po kc ako nakapasok sa previous job ko.kc po nagkasakit ako. And nag advise po ako. Kaya lng po recently tinawagan po ako nun hinihintay ko na work. And wala na po kc ako balak pasukan un previous job ko. And then inadvise ko po cla na hindi na po ako makakapasok. All of a sudden irereport na lng dw po nila ako sa dole. Ano po ba un pwede ko gawin. Please help

You have to inform your employer of your plans regarding resignation 30 days prior to such, and nasa ating labor code yun. Liable ka for breach of contract of employment sa employer mo, especially if they find out that you left them and went to another employer. They can sue you for damages, and rightfully so since effectively nag-AWOL ka sa kanila and lumipat sa ibang employer. May sinusundan kasi tayong due process when it comes to resignation of employees, since hirap din yung employers na maghanap ng kapalit mo, training them again and all.

Ayusin mo muna yung sa previous job mo. Render ka ng 30 days and tapusin mo lahat ng clearance procedures para malinis yung pag-alis mo sa previous employment mo. Make sure to ask the HR of your previous employment kung meron ka pa bang kelangan na gawin na procedure as per company policy to render effective resignation. Kunin mo na rin kung ano pa yung kelangan mo, like Certificate of Employment and whatnot. Your previous employment may become an issue with your new prospective job kapag nalaman nila na di ka nagresign ng maayos sa dati mong trabaho.

Hi po.kaya lng po weeks lng po un pinasok ko kc po nagstart ako ng dec.29 ..and wala pa din po ako contract na pinipirmahan. Job offer lng po un pinirmahan ko. Nagstart na po kc ako sa bgo ko work.pro hindi ko po cnabi na nagstart na ko.

The main problem na meron ka dun sa unang offer sa iyo ay pinirmahan mo yung job offer nila. Syempre, expect nila na kasama ka sa training ng mga bagong hirees for that. Ang job offer kasi, kapag pinirmahan, it means na tinanggap mo yung job offer. In essence, it is a contract that is binding sa iyo and such is generally valid, unless may proof ka na pinilit ka o niloko sa pagpirma.

Go to the nearest Regional DOLE and present a copy of the job offer you signed with the previous employer para mabigyan ka nila ng legal advice kung ano yung dapat gagawin mo to avoid legal repercussions with the previous employer. May mga help desks naman sa mga DOLE offices that are willing to help you out.
