Nakipaghiwalay ang asawa ko this year dahil ayaw nya ng makisama sa akin..nagsimula lang po ito noong umuwi kami ng Leyte..gusto nyang kunin ang atm ko at withdrahin ang sweldo para sagutin ang pamasahe namin pauwi. Hindi ako pumayag dahil sa pakiramdam nya na nabastos ko siya sinaktan nya ako sa harapan ng pamilya niya..pag uwi namin dito sa Cavite. nagdesisyon na siyang makipaghiwalay dahil ineskandalo ko daw siya..sinira ko raw reputasyon at pagkatao nya...isa pa sa nirereklamo ko sa kanya ang di niya pagbibigay ng maayos na suporta sa 2 naming anak..gayung parehas kaming teacher..inuuna nya ang kanyang mga gala...nalaman ko na patuloy parin ang pakikipagrelasyon nya sa dati nyang karelasyong gay...at pagdadala sa aming anak sa taong yun...ano bang legal advice ang pwede ko pong gawin...lalo.na sa support...tama rin po ba na inilayo ko sa kanya ang mga bata dahil prinoprotektahan ko ang mga anak ko sa paglalapit na sa mga ito sa sa karelasyon nyang gay..salamat po

As much as possible, try to settle the issues amicably. If hinde na talaga maayos, ask for support in court, by filing a petition for support. With regards to the custody, you cannot deny the father of his visitorial rights over the children, neither deprived him of that right.

I'm not depriving of his right to visit his children nor his right as father...what I want is to let him do his obligation...what he wants is that he will be the one to take custody of our children...and I will no let it because of protecting my children of his immoral act

Ilan ba ang mga age ng bata? kasi pag 7 yrs old and below, yung custody nila ay dapat nasa mother that's the custodial rights granted by law, however,pag above 7 yrs. old BOTH the father and the mother has the custodial rights UNLESS there is a valid reason for the deprivation, such as brgy. issued temporary protection order, wherein the father or the mother is deprived of custody or visitorial rights.

Immoral acts alone is a subjective fact. It may or may not be detrimental to the best interest of the child as a ground for deprivation.

My eldest is 2 years old..and my second child is 10 months old...he os insisting na di siya magbibigay at wag daw ako magdemand for the needs of our children dahil ayaw ko nmn daw ipakita at ipahiram sa kanya ang mga bata...ang gusto nya nasa kanya ang mga bata at siya ang mag alaga

First thing you should do is to give your husband a demand letter for support. Support depends on the capacity of the husband to give, meaning, base on his salary. You cannot ask for 30k if his salary is only 20k. as for custody tsi ming is correct. children below 7 should be and will always be with the mother, unless the court finds compelling reason to deny the mother of the custody.

Secure a copy of the demand letter you gave to your husband, and if he still does not give support, then go to court for the court to compel your husband to give support, you can also at the same time file a criminal prosecution for VAWC or violence against women and their child against your husband for economic abuse if he does not comply with the giving of support.
