Hello po. Binabayaran ko po iyong lupa na kinatatayuan ng bahay namin on an installment basis at matatapos ko na siya this year. May conditional deed of sale po akong hawak at magiging absolute deed of sale iyon pag natapos ko na ang pagbabayad this year. Iyong lupa na binabayaran ko ay parte lamang ng isang mas malaking lupa at ang existing land title ay iyong para doon sa "malaking lupa".

Magkakapatid po ang may-ari ng "malaking lupa" at may individual shares sila doon. Isa sa magkakapatid na iyon ang nagmamay-ari ng lupang hinuhulugan ko at siya ang ka-transakyon ko lagi. Behind po sa taxes ung "malaking lupa" (kasama na iyong lupang hinuhulugan ko) at hindi ko alam kung kailan nila balak i-settle ung taxes.

Ang tanong ko po ay pwede ko po bang mapatituluhan ung hinuhulugan kong lupa na ang tanging aasikasuhin ko lang ay iyong parte lang na binili ko? May narinig kasi ako na parang kailangang ma-settle muna iyong taxes ng buong "malaking lupa" bago maihiwalay ung parteng binili ko at mapagawaan ng sarili niyang titulo.

Paano po kung wala pang pera ung ibang mga kapatid kaya hindi nila mase-settle ung taxes ng shares nila? Pwede bang i-settle ko na agad iyong parte na binili ko at bahala na sila kung kailan nila gustong i-settle ung parte na kanila?

Ayoko naman pong maghintay pa kasi habang tumatagal ata eh mas nagpapatong patong ang penalties. Mas lalo din naman ayokong bayaran ung taxes ng buong "malaking lupa" para lang mapatituluhan ko ung maliit na parteng binili ko. Ano po ba ang options ko? Hangga't maaari ayoko naman pong umabot sa demandahan or the like.

Klaruhin ko lang ha, ang lupang bibilhin mo ay part pa lang isang kalupaan, wala pang sariling titulo ang parteng bibilhin mo. Kung ganun, kailangan talagang isettle muna ang taxes dyan. Ang gobyerno kasi, is never put at a disadvantage, it is always a priority when it has a claim on something.

Pwede mo namang bayaran yan tapos mag-agree na lang kayo for reimbursement or idi-deduct na lang sa price na lupa.

Thanks Filia. Oo, tama, ung lupang hinuhulugan ko ay maliit na part ng isang kalupaan. Wala pa itong sarili niyang titulo at ipapa-survey ko pa lang. Ang may titulo ay ung mas malaking lupa ("kalupaan") na kinabibilangan niya. Kailangan ko bang ma-settle ung tax ng buong "kalupaan" bago ko mapatituluhan ung maliit na parte nito na hinuhulugan ko? O pwede ko bang i-settle ung tax lang nung parte na hinuhulugan ko?

Hindi ka makaksettle lang ng part mo kasi wala pa yang titulo and in the eyes of the law, hindi pa nag-eexist ang lupang yan, so di pa pwede mabayaran ang taxes para jan (Yong parang wala pang personality) And before mo mapatitulohan yan ang dami mong i-cocomply dyan. Isa na dun ang tax clearance.

Thanks ulit Filia. Bale mukhang no choice ako nito kundi hintayin sila na mag-settle nung taxes ng buong lupa bago ako makakuha ng title para dun sa portion na binili ko.

Palagay ko hindi ito posible in my case. Kung sakali mang bayaran ko ung tax ng buong "kalupaan", hindi na siya madi-deduct sa price ng lupang binili ko kasi halos tapos ko na bayaran ung lupa. Hindi rin ata nila gugustuhin ung reimbursement and would instead prefer to have me wait hanggang convenient na sa kanila na i-settle ung taxes.

Sa ganito pong kaso, safe po bang maituturing kung ang pinanghahawakan ko lang ay absolute deed of sale? Naisip ko kasi baka mamaya ipaayos ko iyong bahay tapos biglang magka-problema iyong lupang kinatatayuan niya (na ang meron lang ako ay absolute deed of sale imbes na titulo). Mayroon din akong mga resibo nung mga installment payments pero sapat ba iyon?

Delikado talaga kasi if time comes, God forbid, magdouble sale sila and the 2nd buyer would be able to register first in his name, wala ka ng laban. All you could do would be to file a case for reimbursement from the seller as well as damages. Moreover, if your right over that property was because there was an agreement between the siblings as to their share (oral partition) and one day one of the siblings goes to court kasi he felt he was at a disadvantage, the court will settle the property anew. The court may give the one who sold the property to u different from what you bought. U will be entitled only to his share. But maybe the court can take you into consideration if you join in proceedings.

Hi Filia. Super thanks sa responses. Hihirit pa ulit ako. Ano ba ang pinakamagagawa ko sa kasalukuyan to minimise any potential damage in the future? Like maybe I should involve all siblings sa absolute deed of sale (posible ba iyon?). What if papirmahin din ung mga siblings sa absolute deed of sale o kaya magkaroon ng ibang kasulatan na magpoprotekta sa akin from "God-forbid" scenarios. This way malinaw na nabili ko na iyong lupang iyon at hindi dapat magkaroon ng double sale o anupaman in the future kahit pa wala pa sa akin iyong titulo. Posible ba ito?

At huwag naman sana pero kung worse comes to worst at wala akong choice kundi mag-file ng case for reimbursement and damages, what if wala na ung seller? Like what if this happens 20 years later at deceased na siya? Sino ang hahabulin pag ganoon?

Kamakailan lang nag-uusap kami sa pagpapa-survey nung area na binibili ko from him at ang advice niya eh gawin ko na lang daw iyon kapag meron ng absolute deed of sale para malinaw ang lahat. Pero ngayong nalaman kong halos wala naman palang bisa ang lahat unless may titulo akong mahahawakan, I'm not sure kung dapat ba akong maging apurahan sa pagpapa-survey.

Clarify ko lang din na we're in good terms nung seller and I truly believe hindi siya iyong gagawa ng masama. Pero kahit siya aminado na mahirap ang usaping lupa lalo na kapag ung generation na ng mga anak nila at mga anak ng kapatid niya (na magmamamana ng mga lupa nila) ang namamayagpag. Kaya gusto ko talaga itong ma-settle ngayon pa lang.

Pag may absolute deed of sale ka na, pwede mo yang ipa-annotate muna sa titulo sa Register of Deeds. Kaso as what I've said, yong share lang ng seller ang sure na mapapasaiyo.

Pwede mo namang papirmahin sila kung papayag sila para parang seller na rin sila at di na nila iinsist sa korte na yong parte na yan ang gusto nila. You can write naman everything sa deed of sale.

Try to do this.
Try to search for a sample deed of sale sa internet. Usually 2-3 pages lang yan. Pwede kang magdagdag ng kahit anong matter of your concern basta make sure na any one involved should be privy to the instrument (he signs). Pag-ok na, pacheck mo sa lawyer kung may naviolate ka na law, pagwala ok na yan kung meron paayos mo na lang din.

Hi Filia. Super thanks! Will definitely follow your advice. Buti na lang nalaman ko ito para alam ko kung pano ia-approach ang absolute deed of sale. Will make sure to coordinate with the seller in the drafting of the kasulatan.

helo Atty.
I plan to buy a 150 sq meter lot whch is a portion of 1 hectare lot,whereas the seller only holds a deed of sale from the orgnal land title whch has a very big land area divided and sold to different people(our vendor is one of them) and holding deed of sale only til now..

what legal document should i hold as evidence of purchase of the 150square meter.
and how could i get that document.

A deed ofsale will do but never waste time to process for application. Kaso matagal yan kasi sa case niyo ipapasurvey pa yan. Ipa-annotate mo lang sa titulo ang deed of sale niyo sa register of deeds.

I meant application for registration.

Anyways, magulo yan. Portion ng portion lang ng big lot ang bibilhin mo. Maniguro ka na lang. Ipasurvey at ipasubdivide muna yan. Nagkakaroon minsan yan ng overlapping ang area or double sale... Pero kung willing ka to take the risk, a deed of sale will do.
