I would like to seek advice we are a construction company with project based. We have employees na nag AWOL and di na bumalik talaga. We do not practice sending AWOL letters kasi company's discretion naman yun but here comes yung NLRC. we receive notice from NLRC na may complaint illegally dismissed daw sila.
When they requested our presence for mediation. I just went there at nag testify na di naman sila dinismissed. Why are they claiming for 13th month, separation pay, backwages and damages?
My question is paano po ba edefend ko yung side ng boss ko. Di kami kumuha ng lawyer kasi we believe we are right. Tumutulong kami sa tao kaso may taong namemera lang talaga. Paano ba yan epresenta na di sila tinanggal? at kung mag file sila ng case na illegally dismissed talaga sila for what grounds naman??nalilito talaga ako please help.
