Hi, need ko po humingi ng advice regarding sa downpayment.

Last December 2009, kumuha kami ng house and lot with Camella Homes. We are still paying for the 20% downpayment which is payable in 15 months. We were able to pay for 6 months until I lost my job. Nasa 100K na din po yung naihulog namin within 6months + 10K na reservation fee.

Ngayon po, we are still not able to pay for the remaining months of the downpayment. Wala po akong copy nung contract na sinign ko when we agreed to purchase the house and lot kaya di ko alam yung terms.

Tanong ko lang po, is it possible na may marefund pa sa amin na pera if di na namin ituloy ang pagbili? Pwede bang magrefuse ang Camella na ibalik ang downpayment namin? May legal obligation po ba kami na ituloy yung pagbili?

We just realized din kasi na mas maraming murang house and lot ang makukuha namin around Cavite.

you should go inquire at camella and learn their refund policy. the provisions of maceda law may apply. if you will have to file a case, it will be at hlurb.

MY contract to sell has no provision for penalty for late payment of my monthly amortizations. They notified me of my balance including penalty of 3 percent per month on my arrears?

If they pursue to collect penalty, what will be the legal interest that I may pay?

Please advise me. Thanks
