Hello good morning.
This is regarding labour law. I was employed by a bpo company for approximately 8 months. I was terminated due to awol after being absent for 20days. I was not given an oppurtunity to explain myself. I had a problem with my colleagues that escalated. I already told our O.M. about it but nothing happened kaya ako umabsent. Ng absent ako na depressed ako at nagka anxiety (I can get medical documents to support this) before i was terminated. Tapos bigla na lang ako tinerminate. Nakalagay sa seperation letter na effective immediately. Mas lumala amg depression ko at anxiety ko dahil dito hinde pa po ako makakita ng work. May laban poba ako? Depressed pa din po ako at mi anxiety dahil dito. Maraming salamat po sa magrereply.

Wala kang laban.

Tamang proseso lang na ma-terminate ka dahil sa AWOL lalo na kung nagpadala sila ng Return-to-Work notice at hindi ka bumalik.

Wala pong return to work order or notice to explain. Derecho napo na terminated. Based on my understanding po pag regular employee e dapat po may due process. Like hearing, discussion kung bakit ko ginawa yon notice to explain. E kahit ngapo return to work wala po.

At best pwede kang makakuha ng konting danyos dahil sa kulang na due process.

Pero tama pa rin na i-terminate ka.

Ah ganon poba. Yung akin lang naman po e hinde po hininge ng employer ang side ko ni kinausap man lang ang problema e sakin at mga colleague ko. Sinabi ko din po sa om ang problema wala din ginawa kaya nagpacheck up ako before ako materminate kasi nga po sa anxiety at depression tapos bigla na lang po ako tinerminate. Maraming salamat po sa pagreply.
