1 DAUGHTER'S SURNAME ISSUE on Tue Apr 05, 2016 1:53 am

I am a mother of two kids (eldest is about to be 3 years old with a different father and the youngest is about to be 1 year old with a different father as well).

This is my current dilemma, the eldest has a different surname with my youngest and the eldest father is no longer providing anything to the kid since day one. I am planning to get rid of his last name to ensure that I have the sole custody of the kid. The youngest daughter's father is the only known father to my eldest, he has been supporting my eldest daughter since then.

1.How can I go about in removing the eldest daughter's last name and changed into mine?

hi, I am not married. Been living with a partner for almost 4 ears who stood up as the father of the eldest. Is there still a possibility that I can get rid of the eldest's last name?

With the biological fathers written permission I thought if the father acknowledged paternity on the Birth Cert

what is the process of adoption? if the child is born in italy with filipino parents and not married? child has no records here yet. how can the mother change the surname to her surname? the mther and son is already living in the philippines.

How would you change a surname that does not exists yet as youve said it yourself, there is no record here?

I think the child's nationality is not a Filipino by birth. I would not change his nationality if that is the case.

hi atty, i have 3 children my eldest and the second 1 has the same father at ang pagkakaalam ko surename ko ang gamit nila nung pinanganak ko sila.. 14 years old n ngayon yung eldest and 12 years old yung pangala nung nakuha ko yung second daughter ko at ako ang nagpaaral dun ko lang n nalaman n pinalitan pala ng ex ko surename ko.pinapalitan nya ng surename nya.. pwede po ba ko magdemanda at ano ikakaso sa knya? and since minor age pa ko nung pinanganak ko mga bata the only thing i've know is sa akin sila naka pangalan at iniba din nya age at name ko mali din.. may habol po ba ako dito? yung youngest ko naman po ibang father pero hindi sya nag support since nagbuntis ako pero gamit ng anak ko yung surename nya, if ever ba na palitan ko surename ng bata at gamitin ko yung surename ko ok lang po ba yun? hindi po kaya sya mahirapan kumuha ng mga requirements lalo n paglaki nya at nag plano sya mag abroad? thank you po...

Hi,

Sorry if it took me sometime to reply.

1. Hindi pa ako kasal sa current live-in partner ko. It is really complicated. Let me further explain myself.

Yung father ng eldest daughter ko, he acknowledge the paternity of our daughter and she is her father's last name. The kid is a pre-schooler now. At the age of 6 months old, her father left us and never heard anything from him at all. Glady, yung ama ng youngest daughter ko stood up for my eldest. I have no issues with my current relationship which is good.

As far I know, yung father ng eldest ko is unwilling to sign any document about adoption. Dati kasi gusto ng sister ko na e-adopt yung eldest ko kaso ayaw talaga mag sign ng father ee.

2. Is there any other option aside from adoption? Is it true that I can still file for a late registration and sasabihan ko lang yung registrar na abandonment?

3. Ayaw ko mag file ng abandonment sa father kasi ayaw ko humingi ng kahit na ano. Kaya naman namin buhayin yung bata and there was never a time na humingi ako sa kanya ng assistance.

4. Once kasal na kami, is it easier for my soon husband to be to adopt my eldest? Or needed pa din talaga yung signature and appearance ng father niya?

5. What's worst po ee nagka issue yung PhilHealth system last year, since 2011 ako yung nag claim sa anak ko. Due to that system issue ee bigla nalang na update at napunta yung claim sa Papa niya. This was the email from PhilHealth:

"This refers to your concern on the declaration of your child under the member data record of the father, Mr. XXXXX.

Please be informed that per Membership Section's validation of the records relative to the audit trail, the child has two dependent PINs (PhilHealth Identification Numbers).  This may be due to the data migration of the new database that created a glitch in the system.

In lieu of the cancellation form of dependents (which is to be filled out by Mr. xxxx), we will be requiring an affidavit stating the personal circumstances such as those you mentioned -- that you no longer have communication with the father so you won't be able to comply with the cancellation form, the child was declared previously under your MDR and has been under your custody since birth.  

Kindly submit the affidavit at our office so we can effect the changes in our system and release an updated MDR."


Pwede ba namin gamitin during the adoption process na he is using the kid for any (1) tax exemption, and those government mandated institution?
