Hi Good day,

Nag seek lang po ng advise regarding my boyfriend's incident. He is now facing a possible termination sentence after being casecon due to taunting a fight with his boss. Story goes like this, at first he used their chatroom to chat with an agent who is asking assistance to with his schedule and after my boyfriend is done with his request, he ask if he can join lunch with them, his boss noticed the conversation and send the report to his manager and filed for an IR (which is the company's rule) in his IR it was stated that this is a malicious act. after a few days, a gossip is spreading in his work place that he is maliciously using his position that cause people to spread rumor about him. one night I saw him bothered and he tell me whats going on in his work palce and told me that he is suprise how the agents know wherein he and his boss and manager is the only people in the said email but prefered to disregard it since he told me it's normal. yesterday he called me and told me that he is now facing charges due to his super visor complaint of harrasment since he confronted his team with what's going on. I asked him what happen? he then told me that they had a team building last week and he preffered to stay to cover the shift and one of his friend team leader told him that he is the hot topic of the said outing. he was told that his supervisor is calling him "Halaman or useless" where in fact he's numbers are good to win awards. he then sees an oppourtunity to talk to his team on a huddle and stated ano bang problema nyo sakin? he ask his super visor in a tone ano bang problema mo sakin bakit mo ko sinsabihang HALAMAN? his super visor denied and said hindi ako un "in a tone also". he said some one told me na ikaw un ano bang problema mo sakin? kung may problem ka sakin pwede ntn "pag usapan sa labas" but he did not say any cursing words,touched anyone in any matter as witnessed by his manager. his manger then asked them if he wants to talk it in her room and he said "ok po". he then explained that all the gossips and rumor that is spreading in the office is ruining his career but he did not complaint even thou he feels like his super visor is not OK with him, his manager even ask, do you want to file for a complaint and he told her "NO" I just want to fix this and he wants to talk about it once and for all since we are a team. when his super visor came in the room, he then ask "ano bang problema mo sakin pre, bakit mo sinabi un" his super visor replies also with a tone, Hindi ako un, may boyfriend ask "Eh sino" and he then reply "ahh tama na to mag cocomplaint nlng ako ng harrasment". Now Gossip is spreading that he "Dirty finger" his boss and some team leader justify to that, he even approach his manager and told her that "Boss, you saw I did not do that" his manager told him Yes I did not see it but they accuse you of doing it. with his suprise everyhting is being spread to his office and suprisngly agents are now seing him differnetly

Sorry for the long story since I just want to indicate some part why he did the said approach.

May questions are:

* Is he now subject for termination since he talk in a tone and say words such as "pwede nmn nating tong pagusapan sa labas" given the humility he got after the said gossip and insulting words?
* Given he did not curse, hit or directly assult anyone aside from the words "pwede ntn tong pagusapans a labas" is a ground for grave offence?
* Since his reputation is being ruined with the said gossips, can he file a seperate complaint now since he feels like his boss can manipulate things.

I don't know enough about the Philippine laws concerning this to give a proper answer, but I know it's "silly" how LITLE can be enough to be a case reason...

COMPARE: In my home country for instance
I have said to bosses:
/What a crap! Things can't be handled this bad! /Followed by telling what is bad AND telling a solution idea if that's not obvious.
Normaly I told about the error CALM the first time, IRRITATED the second time if they didn't solve it within decent time. and ANGRY the third time if it still wasn't solved. Probably I said some curses too Smile
/When I were still in High school they used me as group boss when they had extra much work. Once the WORKERS UNION had complain to the bosses my group had TO MUCH rest !!! (I gave the rest time when I went to move away the done and fetch new material, so they could keep the speed we worked in Smile
-Why are them in your group in the rest room so often? said the boss to me.
-Mind your own business and look at how much more we do than the other groups, I answered.
I suppouse the bosses looked and saw we did around 1.5 times more than the others, because they didn't complain anymore Laughing
Although I had talked angry to the top bosses many times, as soon as I finnished high school they offered me the Planing boss job (temporary substituting 3 months) although I hadn't even applied to that Smile
And my eldest cousin acted similar towards the bosses and him they made Permanent marketing boss when he was only 23, because the bosses find it GOOD we bothered so much about geting the WORK done good so we got angry when things was handled bad...
/Simliar at my third employment. I got a very high salary, although I got angry at the boss often Smile

/When I became developing boss in a software business, I started with telling the programers: "It's ok if you call me "idiot" as long as you tell me why and tell a better solution Laughing Because I WANT them to tell me their ideas, and not being affraid of telling me if I'm wrong. I'm almost never wrong haha but of course specialists have better ideas than mine sometimes.

In my home country it's much worse to be LAZY at work...

hi sir/maam, tgank you for the responses. sadly my boyfriend got fired and he just knew that the manager was with the people in the team building. i feel bad for him since a very patientan and since we are togethwr for years and i never saw him got mad. probably he had enough humiliation at that time..do you think we can file for a case in labor with regards to his termination. he even doesnt want to file a case with the gossip, he just want his job back. Sad

Well. It would be nice to get his job back - so he can QUIT himself Smile
That's obviosly a BAD employer, and will probably become even WORSE for your boyfriend if he get the job back...

I don't know where you live and what he work with, but one of my Filipino friends work for Palawan Pawnshop and have told me very good things about how PP treat their employees, and they have offices "everywhere" so perhaps your boyfriend can try to get work there.
