good day,


pahingi naman po ako mg advice nag rerent lang po kasi ako sa isang apartment dito sa amin. di pa po ako nakabayad ng 2 months kasi po di pa nakasakay ng barko ang asawa ko.

naniningil na po yung may ari ehhh sa wala pa po akong maibigay pa sa ngayun. sabi ng may ari "ipapadlock nya daw po yung bahay at kukuha sya ng gamit para ibenta. mat karapatan po ba akong ireklamo sya? tapos nag bayad naman po ako ng 1 month advance at 1 month deposit. anu po ba ang gamit nyan? makekeclaim ko pa ba yan?

pahingi po ako ng advice at sa ganun alam ko ang karapatan ko.

Did you sign a lease agreement with the landlord? If yes, do you have a copy of it and what are the contents of such agreement? Did it mention anything granting the lessor the rights over your personal property in case of failure to pay rent for at least 2 months?

The one-month deposit may not be for rental, but for any damages incurred in the property because of your stay as lessee. It depends on the lease agreement you have with the landlord, as to what purpose the one-month deposit is.

Clarify with your landlord such terms and agreements that you have with him, and put everything in writing for future reference as to what you have agreed upon with him. Ask for an extension as humbly as you can, since you do not intend to escape your responsibility of paying the monthly rentals. If needed, execute a promissory note on paying your rentals at a specified date to show your good faith.
