1 i want legal advise about my mariedge on Thu Apr 14, 2016 3:07 pm

Hello, i have a problem i want to make legal separation with my wife we are married for almost 6 years we only been dating 4 months she kind of push me into mariage because she became pregnant. I have build 2 houses and swimming pool started as a litle business now its been rented out both by fareigners so she has a good income i still send her almost 50000 peso every month still she always ask more and more i being milked i have a supper loving son i just want best for him i work 8 months and go there 4 months a year to be with them but ever since she became pregnant we dont sleep together anymore up until today nothing happens so i am feeling a bit framed and i want to know how to separate legaly without losing my property by law we own both half but she did not put anything in it all the money came from me from before our mariedge i really don't know what to do she is good in fotoshop she made picture to mislead people that i am seeing someone else my God its so bad i have no words for this I will ask for DNA so at last i be sure if my son is mine I need help i hope someone can help me i stay in Belgium now so i cant see lawyer in Philippines

If divorce is allowed in your country, better apply for divorce. once granted, you can use that as a ground for separation of your conjugal property here in philippines. However, since you are a foreigner, you cannot own a real property here but you can own its equivalent amount after partition.

Its not advisable to file annulment or nullity of marriage here because you don't have a valid reason or grounds to file. Likewise, the proceeding is too long( it take yrs to finish) and expensive without a guarantee that your marriage will be severed.

I can get divorse here yes but what will happen with my property in Philippines ? i put over 6 Miljon Peso all coming form my Belgian account, there is nothing from her to prove its hers so if you say she needs to give me half of the value now it means its over 7 Miljon worth now by improving and where will she get the money even half will be 3.5 Miljon Peso ? It means if she will not sell the place i stay without any money ? i went to ask advice here to my lawyer told me to ask in Philippines becorse here in Europe we have different law in this i got the money before mariage so it means she cant claim any of the property value but that's why i ask your advise
lots of raisons to file devorse on ground being maried for 6 years living a sex less life together just like brother and sister she sleeps in my son's room never in my bed never ever i guess that's also a main big raison why i want to file for liberty
is there a posibility to make a legal document to stay maried but when my son is old enough the property will go to him ?
and a legal way that i can find someone else to share my life with without getting in problems with philippine law and order she might try to catch me with adultery to claim all and put me in jail i have really many questions i been a victim of married for wrong reason.
until now i still send a lot of money i want to know how much a normal person have to give for support of a child

Your properties in the philippines will be divided equally between you and your filipina spouse. You will receive only the equivalent amount in pesos. You cannot own a real property(land) here in the philippines.

Yes. you will wait until the properties are sold before you can receive your equal share.

Yes your lawyer is correct. We have different laws and it so happen that real properties situated in the philippines are governed by philippine law.

No. because philippine laws on marriage also recognize the right of your filipina spouse over your conjugal properties.

You can cohabit in your place but not here in the philippines.

Under philippine law, the amount of support is not fix. It is dependent upon the financial needs of the child. bear in mind that as the child grows, the amount also increases.
