Yes, it is possible to resign provided that the cause or causes of such resignation is or are any of the following circumstances: “(1) Serious insult by the employer or his representative on the honor and person of the employee; (2) Inhuman and unbearable treatment accorded the employee by the employer or his representative; (3) Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family; and (4) Other causes analogous to any of the foregoing.

Sabihin na natin na yung rason ng employee ay wala sa mga nabanggit, ang pwede lang gawin management/employer/kumpanya ay mag-file ng case for damages. Civil action and kelangan dito.
Puwede din magpadala ng Back-to-work-Notice si management pero HINDI pwedeng i-terminate si employee for 'job abandonment'

Hello pu, i have been earning below minimum wage for 4 mnths and my work hours are 10 and 1/2 hours daily. Marame pu health concerns and violations in the work place, nag resign pu aku and gave 30 days notice pero sabi pu nang employer i need to find a replacement and train them for 30 days kahit na wala naman aku naaalalang may ganyan sa contract. They did not even provide a copy of the contract. After the 30 days resignation, can they still sue me for breach of contract even if wala naman silang letter na pinadala to say that i need to train a replacement first? They acce0ted the resignation but i am afraid that they might do something after i leave. ty.

They cannot sue you anymore. You have no duty to train your replacement. Management has that burden. After completion of your 30-day turnover period, you can stop reporting for work. If they sue you, file a complaint.

Hello po. I worked at a call center company.
I passed my immediate resignation effective apr10 pero hindi tinanggap nung company ko kelangan ko daw po magrender ng 30days. Pero yung reason po kasi na binigay ko is personal pero aware naman po sila kung bakit talaga ako aalis. Its because of my reputation, misinformation po kasi sa part ng company. They told me that I got promoted and then after almost a month hindi ko daw po nakuha yung position. Eh alam na po ng buong floor at kinongratulate na rin po ako ng isang manager. I was humiliated. Kaya nagpasa po ako ng resignation pero yun nga po di po nila tinanggap so nag AWOL po ako. Tapos nagpapaalam na po ako magpaclearance kasi kelangan ko na po for requirements sa new company ko. Pero ang sagot po ng TL ko, October pa daw po at hindi daw po pwede iexpedite. Pwede po kaya akong magfile ng case sa DOLE? At kung gagawin ko po yun, may laban po kaya ako kahit walang documentation yung mga pangyayari? Thank you po.

Go to the nearest regional DOLE office and ask help in filing a case against your employer, or you may go to the nearest Public Attorney's Office in a City or Municipal hall and ask assistance regarding your labor case.

Dear Sir, nag file po ako ng immediate resignation dated Apr28 effective Apr29 pero hindi pinayagan dpat daw po 30days.perO nagsuggest ang HR Asst nmen na pede po ang 15days upon approval. Nung nasa company pa akO,naka dalawa o tatlong beses po ako na nakiusap for 15days pero hindi pumayag ung Manager. Pumasok po ako until May13, May16 po hindi na pero nag send email po ako sa Manager,cc:supervisor & hr,unfortunately nagbounce back ung email ko.today, one of my officemate told me na pumasok ako at least 3days pa para daw maclear ako. problema po hindi ko na kaya pumasok,i-awol daw po nila ako. tanung po: tama po ba na i-awol nila akO kung narender ko ung 15days? (pero 15working days po pala ang gusto nung Manager) to compute d working days, naka 11days po ako. but still, i-awol daw po nila ako dahil sa 4days pa na hindi ko pinasok. Please help me Sir, I worked for this company for 6 & years,but unfortunately im not properly paid thats why I decided to leave d company. But I indicated the reasong of leaving is Personal, I need to take care of my 2 kids..

please help.

What complaint are you filing?

Matagal talaga magclearance if AWOL ka, actually some companies will not grant you clearance if AWOL ka.

If you want to file regarding dun sa promotion, you need something concrete kasi kung sabi sabi lang, itatanggi lang ng management yan. A letter or email will do

Unfortuantely ang mandated by law is 30 days so anything less than that is up to them kung papayag. It is well within their rights na i-awol ka

Nasa batas so dapat sundin ang nakasaad.

Pwera na lang kung yung date na binabanggit mo ay pinayagan ng nakakataas sa iyo sa kumpanya.

Kung hindi mo sinunod ang tamang proseso at petsa ng pag resign pwede kang ma-awol.

Oo, mandated by law ang 30 days. Pero kng may resignation letter ka at my date dun na nakalagay at sinunod mo (Kahit hindi 30 days yan) HINDI ka pwedeng i-terminate. As long as natanggap ng employer mo ang resignation letter mo, kahit hindi na-approve yan, HINDI ka pwedeng i-terminate.

Walang nakalagay sa batas na pwedeng mag-terminate ang employer kung hindi sumunod ang sa 30-day turnover period and empleyado. Kahit ang presidente ng Pilinas ay hindi ka pwedeng utusan na magrender ng 30 days kung ayaw mo. Ito ay "INVOLUNTARY SERVITUDE". Ito ay labag sa Constitution ng Pilipinas. Ang pwede lang gawin ng employer ay magsampa ng kaso for damages laban sa empleyado.

Hello po.. Nag resign po ako last week sa work ko effective immediately po ang ginawa ko kaso nguguluhan po ako sa 30 days notice kasi po sa contract na pinirmahan ko is part time and binigyan lang kami ng 100 hours then after ng 100 hours depends sa management kng bibigyan ult kami ng another 100 hours. Dapat ko prn po ban sundin ung 30 days notice kht ganun ung contract ko? Sabi ng manager ko wait ko daw kng maapprove ung resignation ko pero until now walang pa din text galing sa HR,natatakot lang ako baka d nila iapprove tapos baka kasuhan pa ko..need help po

1000 hours po ung contract ko pero 100 hours lang muna ang ibibigay,depende sa performance kng bibigyan ka ult ng 100..ang Mali ko lang po is pinirmahan ko ung contract..pero hnd Ko naiintindihan pra saan and 30days notice kng 100hrs lang ang unang contract then it depends sa management kng maeextend kpa or hnd na. Considered po ba un as collective bargaining agreement?

Ang Collective Bargaining Agreement ay para sa union lang.

Kung nag-resign ka ng immediate at hindi pinayagan, pwede kang ma-AWOL.

if sa contract mo, ang nakalagay ay 1000 hours, renewable every 100 hours at the discretion of management. Then kelangan mag render ng 30 day notice. If you don't, pwede kang ma-AWOL and be terminated

You will usually find out naman beforehand kasi before any charges your employer should send you a return to work order and a notice to explain.

depends sa company but if hindi ka nagrender ng 30 days notice, pwede ka nilang bigyan ng return to work or notice to explain. If meron kang matanggap, it means they have taken step one to have you declared AWOL and then terminated. After this they may file damages against you.

Keep in mind, madami pang steps sa process so it doesn't mean because nag step one sila, itutuloy nila ang kaso against you. Meron ding kasing expenses to file a case.
