Hello pu, i have a question... does tendering 30 days notice mean you need to work for 30 days and hinde counted day off? Or does it mean you just hve to work with a given schedule until that day?

30 calendar days, regular work schedule.

AWOL muna, tapos susulatan ng notice to return, if hindi bumalik saka file-an ng abandonment. In essense AWOL ang first step, abandonment ang last step

Can I ask po? Kasi nag filed po ako ng resignation last January18 (I think, not sure) this year sa previous employer ko. I been there for 9 months. Nag clearance po ako then nung nag follow up po ako regarding on my back pay, may utang daw po ako na babayaran. Bakit ganun? Wala naman po ako liabilities na nagawa sa previous employer ko.

So tanungin mo sila kung bakit ganun, at magpakita sila ng computation para maliwanagan ka.

hindi natin masabi until ma detalye yung mga deductions. Madaming possible na legitimate na reasons. kunin mo muna bago tayo mag comment if pangingikil or not

Hello po.. may tanong po ako about breach of contract po, sana po ay matulongan nyo po ako..

I signed a 3 years contract in a private school po last year April 2015, nagbigay po ako ng resignation letter po May 2016, after ko nagbigay ng letter po eh wala po akong natanggap na any formal letter galing sa principal po namin regarding my resignation letter. Nag inform lang po sya saakin through chat na kelangan magbayad po ako sa kanila ng 20,000 bond po para sa damages po para sa remaining 2 years po at nagbabala po sya na kelangan maibigay na yung pero with in a month po, kung hindi po ay magrereklamo po daw siya sa labor. Through chat lang po yung, wala po akong natanggap na any formal letter po. Atsaka po yung contract po namin ay walang nakasaad doon about bond po..

Questions:
1. Dapat po ba na may formal letter akong matatanggap after giving my resignation letter containing what the company wants me to do like dapat po akong mababayad ng bond or something po at hindi po lang through chat ako i.inform ng principal?
2. Is it reasonable po na singilan ako ng bond po na wala po sa contrata na pinirmahan ko about bond po?

Hi Good day po. nakaabsent po ako ng 1 day sa work ko without any prior notice from 8am-5pm dahil nagka family emergency, just so happened i left my phone. Pagdating ko po ng bahay ay marami ng text ang employer ko without getting my side yet. They considered me AWOL. Ibalik ko na raw ung mga working tools ko at resume na nasa akin. Is it right to tell it to your employee? Kinabukasan pagkasabi ko sa employer ko ng dahilan ko, hindi sya naniwala. Return na raw immediately ung mga working tools and resumes. After 1 day, pinapabalik nya raw ako immediately at wala raw judgement na ipinataw sakin. ano po ba ang return your working tools immediately? i filed my resignation and my Department Head approved it and return my working tools on the following day. kahapon nagtext ung Dept. Head na magturnover daw ako agad agad dahil I abandoned my work daw Or else they will leave the decision to legal Dept. they will go after me

ang sakin po kasi, it is unhealthy anymore to go back to work. Lalong lalo na Nagkaroon ng pang iinsulto sa part ko. Nung una kaya pang tiisin ung mga pang iinsulto ng manager ko pero nung nai broadcast nya ito with the team members of the HR nawalan na ako ng gana mag work. Pwede ba nila ako i-sue for the action I did? and almost 2 weeks na rin iyon

Ang AWOL kasi means absence without leave, tutuo naman na absent ka without leave, so technically AWOL ka that time until ni present mo yung reason mo.

If sa pakiramdam mo ay nainsulto ang pagkatao mo dahil sa nangyari kelangan mo ng katibayan para hindi ka demanda for damages, if verbal yung pagkasabi ng manager kumuha ka ng testigo na magsign sa affidavit tungkol sa pangyayari.

pero sir, ang concern ko lng ay, bakit kailangan ipabalik n agad ung mga working tools? ang ibig nyang sabihin ay we no longer need you.

may sinabi sya sa team na i dont see you are dedicated to your work, i need someone who is energetic! committed to work! and i dont see it to you. though during the meeting she praised me. tapos nung kami kami nalang sa recruitment team sasabihin nya un na galit na galit..sasbihan ka pang walang gngawa. hayyyy

If gustong ipabalik eh di ibalik, tutal sa kanila naman yun. You have to understand your actions have consequences, para maiwasan ang damages/penalties you have to have affidavits and witnesses. Kasi kung ikaw e salaysay mo lang ang pagbabasehan, masyadong up to chance ang katayuan mo. Siguradong meron silang sariling version nila of what happened.

You never know, they might also produce a witmess of their own to refute whatever you may allege

yup, i have my witness regarding what happened. dalawa kaming nasabihan ng ganun but we don't think we deserve those words. do I burden all the consequences? Is it unfair that they demand me to return my working tools and demand me too to turnover and may pananakot pa na they will go after me? I think i have done my part na binalik ang mga working tools. Nasa office lang nmn lahat ng files. Can I win in this case if ever I will consult to DOLE?

kung baga pinalayas ka na ng employer mo sa sinabi nilang return your working tools. And I dont think it would be healthy to stay or turnover with my manager. First and foremost, the unhealthy working environment pushes me to do this action.

Yung regarding sa working tools wala ka talagang laban dun.  

Re sa winning the case: In my opinion medyo grey area, medyo mahirap kasi yung mga "kung baga" subject to interpretation.  Mas concrete is if sinabi na wag ka nang pumasok or something specific. Yung mga "unhealthy etc" is too subjective in my opinion.  pagalingan nalang talaga ng lawyer.

But yeah consult dole first, tutal free naman yun

ang mahirap nga nun ay sinabi nya na pinababalik daw nya ako immediately. which is wala naman sa mga tinext nya before. after na ng 3 days after I filed my resignation. Ang dating sa employee if ever na pinababalik na ung working tools, paano nya magagampanan ung work nya kung wala ung mga working tools. and besides working tools lang ang pinababalik immediately. I don't know if tama ung pag cocorrelate ko ng mga sinabi nya sa idea na nasa akin as an employee.

Pagpinapasoli, eh di isauli, hindi mo na problema yun if you cant perform your function without those tools. They can't sanction you if they are not providing you the tools required.

Hi po, I've been working for my current company for 2 months now and I haven't signed a contract yet. I am planning to resign now. Is it ok if I will not render 30 days? The only document I signed is the my job description. Please give me an advice. I don't want to stay here any longer.

nakalagay lang dun is yung tasks ko. but they I did not sign any contract

kahit na walang contract if hindi ka magrender ng 30 days pwede kang kasuhan ng employer mo for damages. Kung magkano yun, nasa korte na ang decision
