ayoko pu sna magresign pero wala pu kc tlga magaalaga s mga anak ko nbgyan n pu ako ng consideration n mkpg unapid leave para makahanap ng yaya kau ang hirap pu tlga humanap ngaun ilan beses n ako niloko n manghihingi ng pamasahe pero d dadating..nagkasundu kmi ng boss ko n once n sablay p din pu un huling yaya n inaantay ko ay mgresign m ako at ganun n nga pu ang ngyari wala nga din pu yaya n dumating..sabi pu ng boss ko kailangan ko daw magrender or else materminate ako..willing pu ako magrender ng 30days pero paanu pu kng wala tlga mgbantay s mga anak ko..naiintindihan ko nmn pu ang procedure ng pagreresign ang hinihingi ko lan pu tlga ay last consideration to let me resign asap para d n din maapektuhan ang attendance nila hindi ko din pu kc maipapangako kng kelan magiging ok ang pgdating ng yaya..wala n pu b ako iba magagawa kundi ang mgpaterminAte n lan..un n lan pu b tlga ang pwd ko gawin..salamat pu..

Magpasa ka lang ng resignation letter mo at ipa-note mo sa kopya mo na na-receive nila ang resignation letter mo. ('received' hindi 'approved') Kapag natanggap nila yan at hindi kna pumasok ay hindi ka nila pwedeng i-terminate kasi kung pipilitin ka pa nila pumasok ay "involuntary servitude" na yan. Ang Phil Constitution mismo ang nagbabawal nyan.

Wala sa Labor Code na pwedeng i-terminate ang empleyado kung hindi nag-render ng 30 day turnover period. Ang nakalagay lang sa batas na pwedeng gawin ng employer ay humingi ng danyos. YUn lang ang nakalagay sa batas at wala ng iba.

in theory, pwede pa rin ma-terminate pag hindi nag render ng 30 days.

pag nagpasa ng resignation ngayong may 15, para effective jun 15, at hindi na sumipot ng may 27 - therefore ma-a-AWOL sya (after following process).

Terminate? On what grounds? Abandonment of Work? How can it be abandonment of work when there exists a resignation letter. Approved or not, there exists a resignation letter. Abandonment implies that the employee INTENDS to abandon his/her work. How can it be abandonment if the true intent of the employee is to resign.

You are living in the old world. You are susceptible of being sued. As between the Constitutionally guaranteed right against 'involuntary servitude' versus the Labor Code provision of a 30-day turnover period, the former will prevail.

He leaves before the required date ergo it is eventually abandonment.

How do you classify someone who resigns effective June 30 but does not report anymore by June 5?

NOTE: The query states no definite date/period of resignation as well as the effectivity of such. The matter states an issue on when the employee opts for an immediate resignation and the employer refuses such.

With this regard, the employer cannot legally reject a resignation letter AND terminate an employee by reason of Abandonment of Work as it is contrary to the rationale laid down by the Supreme Court on numerous cases.
