Let's say nakabuntis si Lalaki ng ibang babae other than his wife. Then hindi pinanagutan yung binuntis na babae dahil hindi sya sigurado na sya ang ama nung ipinagbubuntis ng babae and instead, promised to help help her na lang through her pregnancy until sa manganak ito.

By the time na nanganak na yung babae, yung kapatid at ina nung nabuntis na babae ang nakakausap nung lalaki. Nanghingi yung nanay ng babae ng pera (aabot sa 20k) sa lalaki para daw sa pagaayos ng birth certificate ng bata para daw mapunta yung custody sa nanay nung babae.

Question po is Valid po ba itong panghihingi ng ina nung babae sa lalaki para ayusin ang Birth Certificate nung bata?

Ganun ba kamahal magpagawa ng Birth certificate? syempre hinde
And technically kung hindi papanagutan ng lalaki ung bata syempre nakaapelido ang bata sa nanay nya.
kaya ang custody ay nasa babae pa din (sa nanay ng bata)
Ang tanong jan namatay ba ung babae habang nanganganak?

Thanks for the response sir. So bale may practice din sa pagpapagawa ng Birth Certificate? If that's the case, naloko pala yung lalaki na magbayad ng ganoong kalaking halaga para lamang dito.

How given the same scenario but different settings.

1. Yung babae ay Kasal.
2. Yung Last Name nung bata ay nakapangalan sa asawa nung babae.
3. Hindi naman namatay yung babae sa panganganak.

1. Adultery case can be filed against her by her legal husband if that is his intention.
2. Less headache for mom and for baby. Big headache for legal husband.
3. Did mother died on first story?

Back to the Topic, is it possible talaga na ipaayos yung Birth Certificate kung saan ang Paternity rights ay mapupunta sa Nanay nung babae imbis sa ama (legal o hindi)?

Wala namang binanggit na acknowledgement ang 2nd man sa bata o pinirmahang BC o papel na inaako niya ang bata, bukod sa kasal ang babae sa unang lalaki. So afaik walang paternity rights at visitational rights ang 2nd man. Wala siyang dapat ikabahala kung iyun ang nais niya.

Afaik wala (pang) anumang karapatan ang 2nd man sa bata base sa nabanggit na istorya.

Kung fully acknowledged ng 2nd man ang bata, ang paternity rights ay maari lamang mai-wave sa courts of law ng atleast isa sa magulang ng bata (at hindi lola ng bata o sinumang hindi direct guardian ng bata). Isa sa paraan ng pag wave nito ay legal adoption kung saan nararapat madinig ang pagsang-ayon/panig/consent ng mga magulang ng bata sa loob ng korte. GL

Thanks for sharing your insights on this.

I don't think maghahabol yung 2nd man doon sa bata since in the first place, he was hesitant to acknowledge the child as his due to the nature of work nung babae. Ang concern lang nya is is gusto nyang malaman kung kelangan ba talaga magbayad to change the paternity rights sa BC ng bata from the father (alleged or legal) to the mother of the woman who gave birth to the child dahil yung 2nd man ang pinagbayad nito.

Simulation of birth is a criminal offense. Better not to indulge to such practice or be an accessory to it as it is against the law afaik.

So yung pagsasabi ng Nanay nung babae na papalitan yung Paternal Rights from the Father (Legal or Alleged) to them can be considered Simulation of Birth?

And given na Criminal Offense po ito, what would be the Penalty?

As long as it is not done legally thru court or thru the process of legal adoption, then any illegal changes on child's BC via fixer is a crime of simulation of birth afaik. Apektado kasi dyan ang affiliation, inheritance at paternal rights ng mag ama.

Kahit apo o pamangkin niya pa ang bata. Kulong, 8 years yata
