Hi Sir and Mam,

please help me on this issue. I got promoted last sept 2015 however the company said that my salary adjustment will be given on my annual date evaluation which is december 2015. It was written on a memorandum signed by HR, Operation Manager and General Manager. Until now i havent received any salary adjustment.

Question:

1. does the company have violation on labor code already by not giving me salary adjustment last december 2016?

2. if the company will give the salary adjustment? should i also receive retroactive pay because of the delay?


please help me on this.

hi good afternoon, ask ko lang po kung legal po ba yun ginawa ng boss namin na every time nag violate kami ng rules for example using cellphone on duty, kapag nag violate ka one day salary deductions, tpos everytime po na may mag violate puro one day salary deductions, pa tulong namn po salamat po!!!!

Hi lukekyle,

but it says on the contract that the salary adjustment will be given on my annual evaluation? so thus it mean that if they decided to give me low score on my evaluation i wouldnt receive anything?

ireretro yan. ifollow-up mo din sa HRD nyo. huwag mo ibibigay sakanila yung memorandum ha. better keep a copy at home.

just in case di nila iretroactive and di nila binigay does it mean violation na sa labor code?

its says on the memo:

we are pleased to confirm your appointment as Team Leader. Effective Sept. 2015.

your salary adjustment will be given on your annual date evaluation schedule on dec. 2015.

Since hindi specific yung nakasulat, pwede kasi sabihin na 0 ang salary adjustment. I'm guessing you are basing your expected increase on the salary level ng ibang team leaders? Parepareho ba ang salaries nila? Pero i would suggest followup mo sa HRD before coming to any conclusions.

ah ok po salamat po,,
ask na lang din po ako regarding sa mga change shift po or change day off required po b yun na kapg hnd ka nkapag file eh hnd ka sashudan ng employer?? legal po b yun???

pumasok po ako may schedule ako pero nakipag change shift po ako.

in my opinion they may be well within their rights to withhold salary for that shift change. But i have not yet encountered anything similar to this scenario so my knowledge is limited

Required kayo siguro to have a form approved by supervisor and noted by HR before makipagpalit ka ng sched o shift. Parang sa overtime, dapat authorized. Tapos kailangan itatabi mo yung kopya mo ng approved slip or form para kapag hindi ka binayaran i-attach mo sa gagawin mong salary complaint kasama ang photocopy ng payslip mo addressed to payroll and hrd nyo.? hindi naman siguro informal sector ang work mo?

yes if hindi ka pumasok the day before regular holiday and hindi ka din pumasok on the holiday itself. hindi ka babayaran ng holiday pay

lukekyle is correct. also, keep in mind that you must render six (6) straight work days para ma-avail ang restday benefit.
