Hi,

I was working in a company dati (2 yrs na akong wala, good thing.), na may sariling LABOR CODE.

1st, no work no pay...wala rin silang sick leave/ vacation leave benefits. Kahit may sakit at may doctor's certificate, kaltas pa rin sahod mo. Also kapag malubha sakit, like nung symptoms ko going to dengue na, 3 days na akong di nakakapasok, my boss called me and scolded me sa phone na di raw pwede yung ginagawa ko and possible dengue lang naman daw yung sakit ko di naman daw dengue talaga. So 4th day napilitan akong pumasok kahit sobrang di ko kaya.

2nd, SSS contributions namin ay naka voluntary para wala silang contribution. Wala rin kaming tax at PAG IBIG. May mga months pa na deducted ang SSS ko sa payslip pero di nila binayad sa SSS. Only saw this nung wala na ako sa company at nagpa update ako ng contributions ko.

3rd may mga rule sila sa late, 16 to 20 minutes late penalty of 50 pesos on top pa sa minutes late mo.....21 to 30 mins late, 100 pesos on top sa minutes late and last 31 mins late is 150 pesos penalty on top sa minutes late mo.

4th absent is without pay plus with 300 pesos penalty pa, may mga workers kami na 300 pesos per day lang ang sahod, so kung absent, wala ng bayad, minus 300 pesos pa, so parang 2 days kang absent. Memo pa pag walang doctor's certificate.

5th Overtime pay is only applicable after an hour. For examaple may tinatapos ka pang project and nag extend ka ng 30 mins...di pwedeng i file ng overtime. Pero again pag na late ng 16 mins, 50 pesos penalty.

6th No 25% on overtime pay, No night differential pag nag-overnight work ka, also NO PAY pag special holiday, pag pumasok ka naman ng special holiday wala ring 30% additional sa pay.

Ito po bang mga nabanggit ko entitled ako sa immediate resignation? Kasi up to now inipit nila yung last salary ko, yung 13th month ko di nila binigay and sabi pag hinabol ko they will file a case against me for my abandonment of work daw. Pero may resignation letter po ako na binigay na immediate resignation po...kasi nga po di ko na kaya yung mga illegal rules nila na against sa LABOR CODE.

Also pwede ko pa po bang ireklamo sa SSS yung mga deductions ko sa contributions ko na hindi nila ibinayad sa SSS? May makukuha po ba akong compensation pag na prove na sinadya nilang di i-remit yung bayad ko?

If may prove na hindi ni remit ng company yung kinaltas sa inyo, i treat yan na parang nag remit sila, meaning you will be entitled to the benefits na dapat meron ka if nag remit sila. Pwede rin silang patawan ng fine or makulong. Pero yung fine sa govt babayran, hindi sayo mapupunta.

Re yung immediate resignation, you have to check if the violations they have committed are penal in nature. Ibig sabhin yung violations ba nila ay may kulong if napatunayan?

1st - no work no pay ay nasa labor code.
Regarding sa leaves - this is a violation if you can prove na walang service incentive leave ang company Ang problem mo ang SIL ay pwedeng ipunin at ibigay sayo as cash when you resign after you get your clearance. But since hindi ka nag render ng 30 days, pwede sabihin ng company nandito yung SIL nya pero since hindi sya nagclearance hindi nya na matatatangap ito.

2nd - this you can probably use as a reason for your immediate resignation but please check with a lawyer if this can be viewed as a crime commited against you or if it is considered as a crime committed against the SSS.

3rd - while it is illegal to deduct against salary, pwede kasi i-argue na this are for damages caused by your being tardy. Medyo grey area but if i were to guess this might be a violation

4th same as 3rd

5th most probably a violation

6th a violation except Special holidays are no work no pay unless meron kayong agreement to the contrary.

What you have to check now is are these considered penal and are they crimes against you? I would suggest you ask DOLE or a lawyer

For example, if hindi nagkaltas ng withholding tax, yan eh against the BIR not against you kaya hindi mo pwedeng gamitin na reason for immediate resignation. Then there are violations na hindi considered crimes such as not following procedure when enforcing disciplinary action.
