Magandang araw po.
Ako po ngayon ay nasa ibang bansa. Ipinadala/Ipinahiram po ako dito ng aming kumpanya para magtrabaho ng tatlong taon. Makalipas ang halos isang taon, ako po ay na-demote. Sa akin pong pagsusuri ay illegal ang ginawa nila dahil bigla na lang akong nakatanggap ng announcement na nagsasabi ng aking demotion pero walang nilalamang rason at hindi rin ako hinihingan ng paliwanag.
Dahil dito ay gustong gusto ko pong mag-resign na at mag-file ng kaso laban sa kumpanya ko. Kaso po may 2 taon pa na nalalabi sa kontrata ko dito sa ibang bansa.
Maari po ba akong magbitiw sa aking trabaho na walang pananagutan sa kumpanya o kailangan kong magtiis at tapusin ang 2 taon bago ako magbitiw at magsampa ng kaso?
Kung palilipasin ko ang 2 taon, may habol pa rin po ba ako na magsampa ng kaso?

let's take the practical view first. can you afford to be jobless and the cost of coming home to be paid by your own money?

why don't you first send a letter to your employer to question this demotion and inquire what is the basis. you should also inquire at the philippine consulate there regarding local laws.

Salamat po sa pag-sagot.
Linawin ko lang po ang sitwasyon ko. Ang kumpanya ko po ay base sa Pinas. Tapos po ipinadala lang po ako o ipinahiram dito sa ibang bansa para magtrabaho sa kliyente.

Kaya ko naman po mawalan ng trabaho at kung pamasahe pauwi po, kaya naman. Ang kaso po, baka po pagbayarin nila ako kung biglang mapuputol ang contrata ko dito. Yun po ang di ko kaya. Nangyari na po kasi ito sa iba kong kasamahan na umuwi. Sa ginawa po nilang illegal demotion, may karapatan po ba sila na pagbayarin ako?
Kinausap na po nila ako regarding sa demotion pero yun ay pagkatapos lang po nila ibigay ang demotion notice sakin.
Sa notice na yun, wala pong reason na binanggit, walang paliwanag na hinihingi. Tapos po retroactive pa mula simula ng buwan na ito.

why were you demoted?

to be honest, i am not sure how local labor law will apply in such a situation. this is why i recommend that you seek legal advice at the philippine consulate.

Hello po.

Sorry po at ngayon lang ako naka-reply. Medyo pre-occupied po sa trabaho. Nandito pa rin po ako sa ibang bansa at sa parehong kumpanya pa rin nagta-trabaho.

May rule book po kami sa company at stated dun na when an employee receives 2 consecutive poor ratings he/she will be terminated. Pero pinalalabas pa nila na utang na loob ko na demoted lang ako at hindi terminated.
Yung poor rating ko po ay questionable. Yung 1st po, hindi ako binigyan ng due process. Hindi po ako binigyan ng Feedback Interview na standard procedure sa amin kung saan sasabihin sa amin kung saan kami nagkulang at paano kami magi-improve. Ilang beses po ako nag-request ng interview na yun pero hindi po napagbigyan. Yung 2nd po,nagkaroon na ng Feedback interview pero wala namang pong supporting docs ang claims nila na hindi ko nagagawa ng maayos ang trabaho ko. Puro po opinion lang ng Team lead. In fact, ilang ulit na po ako humihingi ng copy nung appraisal docs ko nung 2010 pero until now(2012) hindi nila ako mabigyan. Dun sa appraisal docs na yun dapat naka-state ang mga sinasabi nilang shortcomings ko sa work.

Tapos, biglaan rin ang ginawang demotion sakin na hindi man lang ako hiningan ng explanation or chance na ipagtanggol ko ang sarili ko.
hindi ko po makuhang mag-resign pa dahil ayaw ko nalang i-breach ang 3 yrs contract ko. Isang taon na lang naman ako dito.

Ginawa ko po ang payo nyo at galing na rin po ako sa Philippine Consulate. Pero hindi daw nila ako matutulungan dahil 1) main company ko po ay nasa Pinas; 2) Intra-company VISA lang po ang hawak ko na kung tutuusin daw ay hindi nila sakop.

Gusto ko po malaman nila ang mali nila at itama ang maling nagawa sakin.

your remedy will be to file a complaint for illegal demotion at the nlrc

Another question po. Kasi this demotion happened last year and I couldn't file a complaint dahil nga wala ako sa Pilipinas. Can I still file this complain when I return to the Philippines next year?

Binabalak po ng management namin na ibalik ako sa dati kong post. Dapat ko ho ba itong tanggapin gayung balak ko mag-reklamo? Kung tatanggapin ko po ito, pwede pa rin ho ba ako mag-reklamo?
