Hello,

May concern lang po. HR po ako ng isang company (1 year experience). Tinaasan po ako ng boses ang manager ko kasama ng mura sa harap ng mga emplayado sa office. Totally pinahiya. May mga nireport kasi ako naconcern about sa complain ng isang emplayado na may ginagawang kalokohan ang kasamahan nya sa department nya.

Nag request ang complainant na itago nalang pangalan nya dahil babae sya laban sa lalaki na ni report nya and ayaw na nyang madamay pa and besides hindi lang naman sya ang nag co complain.

Nagalit ang manager sakin ng tinanong nya kung sino ang nag report and sinagot ko na "as much as possible anonymous po sana ang complainant, manager" pero in the end willing naman ako sabihin ang name ng complainant. Nagmura pa sa loob ng office. Tama po ba na itago ko ang pangalan ng complainant dahil sa privacy nya?

In my opinion, your action is not actually wrong per se. However, as your superior, your HR manager should know all that is happening within the department. Since office camaraderie is based on trust and as a matter of courtesy, you should have divulged the name because, like you, your HR Manager is also bound by confidentiality. Besides, his head is on the line with regard to his department and not yours.

cursing is definitely wrong (cursing is also prohibited in our code of discipline). BTW he is the general manager not HR manager. Its not really my plan to keep it confidential. what im trying to express is the complainant explicitly requested her identity not to be revealed for security reasons as long as possible and yet i'm willing to divulge her name so long as im confident that the concern will be dealt with properly... (complainant are girls.. complaining about a warehouse boy regarding his foul behaviours which causes too much friction with his coemployee- other warehouse boy)
here's our brief conversation

(this is all from skype but the curse and further reprimands are vocalised)

Manager:if my ngcocomplaint at nalaman mo kung sino let me talk kung sino mga involve wag mo ako pgtaguan
not valid reason nila if ganun
I will tolerate what ***** is doing

Me: sorry po... not to offend po.. pero po as much as possible i anonymous ko daw po ang complainant as per Atty. pero kung ito tolerate mo po si ******, baka mag reflect din po yan sa management..

copy paste ko isa sa complain kay *****, proof na for benefit of the company ang sinasabe ko...
wait lang po
Complainant: "sabihan mo mga tao ng warehouse na ang bubble wrap hindi binili pra putukin at paglaruan lang nila DAHIL trip
Lalo na si ***** ..
pasimuno sa ganung klase ng trabaho"

Ang gawin mo na lang ay gumawa ng IR laban sa Manager na yan at ipasa mo sa HR manager mo at sila mag-usap.

Thank you po sa advice. problem is.. this is still a growing company with 50 employees. positions are more or less multitasking. After 2ng owner ng company is General Manager then ako na... HR Officer po title ko. sya na may hawak ng authority. mali po ba ako kung feeling ko na harass ako? wala na po kasi ako magawa sa authority nya. dinidikta nya na boss sya at walang saysay ang decisions ko whether may advice na ng legal counsel namen. nag iisip na po ako mag resign.

Manager: "gusto ko if my report ka skin wla kang itago
khit pa sabhin ni atty or nino man
ako ang boss mo dito"

actually, kung hindi gagawa ng formal report yung nagsumbong sa iyo, wala kang dapat gawin kundi irelay all the info sa manager mo. wala bang supervisor yung department na yun? yung supervisor ang kakastiguhin ng manager for sure hindi ikaw. kapag nagsimula sila ng papertrail, duon kana papasok kasi trabaho mo na yung pagproseso nung mga DA/SANCTION/201.

2 owner---> 1 gen manager ---> 1 hr officer -----> 4 dept haeds (team leaders)
mga personnel concerns sakin nilalapit... hindi na dumadaan ng TLs nor derecho sa manager. usually ako talaga nag aayos ng mga concerns... but since nag instruct ang manager recently na wala na ko gagalawin na concerns binigay ko na lang sa kanya lahat.. 1st time na nag comply ako sa ganitong rule.. yan agad ang nangyare... hindi na raw kasi importante ang concern. i mean.. ang dismiss ang manager ng walang further investigation kahit na marami na ang complains. dahil walang nangyare sa complain till now, mga emplayado with association sa nakacomplain nag aaaway away lagi...

@Mc2012... yes, that's exactly what our legal counsel advises me... and currently I'm writing my resignation letter.. it's just that I'm preparing my move (naniniguro na ko kung meron ba'ng legal na sabet sa ginawa nya) when our manager decided that he is not yet done while I'm preparing for my exit... (which would demand 30 excruciating days for me)

Pasok po ba sya sa harassment? or defamation?

Wala akong balak na gumanti or anything. Gusto ko lang manigurado kung balak nya pang pahabain ang issue.

@HRDude.. Smile my original question goes like this: is the complainant entitled to privacy? (complainant is girl reporting a boy that causes conflict (sapakan) among his co-employee) at mabigyan ng pansin ang nireport nya hindi lang basta balewalain? wala kasing nangyare sa report nya till now. binalewala lang ng boss. ung kinompain nya kasi na si J***** hanggang ngayon sobrang pasaway marami parin nag cocomplain. na sidetrack nalang ang topic Razz
