Hi good day atty! Kase po yung tito ko nagtatrabaho sa kumpanya for 19 years. Actually 9 years siya sa company A after nun nagtayo ang company A ng sister company B nilipat sila sa company B 10 years nasa company B sya. Pero ngayon magclosed na ang company B ngfile sila ng bankruptcy sa DOLE. Ang sabi sa tito ko ng manager nila gumawa daw ng resignation letter ang sabi ng tito ko mgconsult daw muna siya kinabukasan ang sabi ng manager wag na raw gumawa. Ngayon Pinapili sila its either itutuloy nila ang ang work nila ililipat na ulit sila sa company A na tuloy tuloy pa din ung counting years nila or kukunin nila ang offer na ayon sa computation ng company na 19 years then absorbed ulit sila sa company A but different benefits than the other employees. Tanong ko lang po kung anung pwedeng aksyon ang gawin nila? And ang sabi ng manager nila ng una kapag gumawa sila ng resignation ung makukuha nila is walang tax tpos ngayon nung hindi sila gumawa ng resignation kase bakit pa nga daw sila gagawa eh wla naman sila kasalan kung bakit magsasara ang company B, nagkaroon na po ng tax. At nsa 32% percent po ang ang kaltas kung sakaling kukuhain nila hindi ko po alam kung separation pay po ang tawag dun. Sana po matulungan ninyo po ang tito ko at mga kasamahan nila 4 lng po silang employee sa company B. Maraming salamat po sa pagtulong at sa advice na maibibigay ninyo atty. godbless po

ayon sa batas if magsara dahil sa financial losses, walang separation pay na makukuha ang tito mo. Ang mandatory lang ibigay ay ang sahod nya, tax refund if meron, 13th month pay and unused service incentive leaves. if meron pang karagdagang ibibigay maliban dyan eh extra nalang yun. unless na may CBA or kasunduan sa employment contract.

Hi atty,

Ang alam ko po is may kasunduan sila 5 years pataas may makukuha po sa company. Pero sir question lng po is it right na 32% percent na tax ang ikakaltas nila. Ang alam ko po kc kung sakaling kunin nila ang offer is may mkukuha po sya mahigit 500,000 po, nung una ang sabi po kapag ngresign sila walang tax tpos nung sinabi nila na hindi sila gagawa ng resignation ngayon po taxable na ang makukuha nila. And 32% percent po tama po b un gingawa ng company nila? Thank you so much atty. godbless

Bihira kasi na nakasulat sa employment contract na pagnalugi ang company meron matatanggap ang employado. If wala kasing kasunduan the fact na may matanggap ka kahit piso magpasalamat ka na. so kahit magkano ikaltas nila since hindi naman complusary pwede.

Pero kung may kasunduan hindi sila dapat magkaltas sa separation pay dahil ito ay tax exempt.

Pero make sure na classified as separation pay ito. Baka iba ang pinag uusapan natin

Yes po separation daw po. Pero ang sabi po sa kanila bago daw nila makuha ang separation na un gumawa daw po muna sil ng resignation letter. Kase kung hindi daw sila gagawa at maipasa na nila sa DOLE ung papers nila wala na daw sila makukuha. Ang separation pay po nila ay may tax daw po na 32%. May pinakita po sa kanila na ang nakalagay

They are correct, if mag file sila sa DOLE ng closure due to financial losses wala ng matatanggap yung tito mo.

If you use this logic .... since wala naman dapat matanggap ang tito mo, and meron na ni offer yung company, then kahit magkano ikaltas nila ok lang diba?

Pero technically if ni classify sya as separation pay, hindi sya dapat taxable

pwede kayo kumuha ng certificates of tax exemption sa bir, para hindi kayo kaltasan

Hello Attorneys.

Today i have been given dire news. That i would not be paid for my last 30 days of work. According to the institution they made me render 30 days only to release my supposed last pay. The truth is nagka conflict with the owner of the company dahil layaw nila ibigay ang last sallary ku. Pinag render aku nang 30 days at ayaw ibigay last sallary ku nuon dahil wala aku nahanap na kapalit kaya ayaw i sign ang clearance ku. Maayos ang usapan na i will be paid for my last 30 days of service tapos ngayon sinasabi na it was only compliance para walang BREACH OF CONTRACT . They threatened to sue me with breach of contract nuong umaalis aku date because wala aku kapalit at walang 30 days notice. Nagka agreement with the owner na mag rerender aku nang 30 days and will be paid for it. Pagmumukain na lang raw na may tinrain aku to protect me from company Policy. Ngayon ang sabi i will not be paid for my last 30 days. During my stay hindi nahulugan ang SSS at hindi aku nabigyan nang BIR or tin number. Walang kahit ano , not egen hazzard pay. What can i do? pleaaaase help.

Firstly, hindi ka dapat dito nag post kasi ibang thread ito.

True naman that you should render 30 days notice so they will not sue you for damages, but yang 30 days na yan should be with pay. You can file a complaint sa nlrc

Opo sir ok po ganun nalang po ang gagawin po nmin. 5 years pataas po nagbibigay ang company nila ng separation pay po kahit po magresign may natatanggap po. Pero walang tax po, pero ngayon nagtaka po sila kung bakit nagkatax po. Ok naman na po sa mga CEO ang kaso ang bagong atty ng company ang ayaw po pumayag. Kaya ang sabi pakaltasan daw ng tax po actually hindi naman po talaga un ang tunay na dahilan kung bakit sila magsasara hindi dahil bankrupt na ang company kung hindi ayaw na nila ipagawa ang machine po dahil masyadong mahal mgpagawa.

i dont see any reason why hindi sila papayag, yung kinakaltas nila ay ni reremit din nila sa govt kaya whether may exemption or wala, may kaltas or wala pareho din ang cash out nila.
