Arresto Menor
Hi admin,

Hihingi sana ako ng advice tungkol sa hindi nabayarang REAL ESTATE MORTGAGE (REM) ng yumao nang mortgagor.

Ang principal ay P500.00 at may annual interest na 12%, due after 3 years. Ito ay may kasulatan, pero hindi notarized o registered as REM sa Registry of Deeds. Year 1967 na-execute ang kasulatan. 2016 lang naniningil ang mortgagee sa heirs ng lupa na nakasaad sa kasulatan na may halagang P400.00 nang panahon na iyon.

Pwede po bang maghain ng foreclosure ang MORTGAGEE?

At kung pipiliin ng mortgagee na i-settle na lang ang utang through payment, magkano po ang ibabayad ng HEIRS OF MORTGAGOR?

Valid po ba ang claim ng MORTGAGEE na ang payment ng utang ay apektado ng INFLATION RATE?

the amount payable should be simply based on the original amount plus the interest rate agreed upon.
