Hi Attorney gusto ko lang po magtanong kung pask ang kaso ko sinampa agaisst my e-bf. Niloko nya po ako, sinabi nya na wala pa sya aswa at pamilya, pero nalamn ko na lang na mern pala. kc yunyun tie na ng investigate na ako tungkl sa kana dahil di na sya ngttext ako di na sya nakikipagkita sa akin. sya po ang unang lalaki sa buhay ko kaya nakaranas ako na matindding depresyon. Attorney, simula na n malamn ko ang tungkol sa kanya, bigla na lang say tumawg at pinagmumura ako sa phone at tenext nya ako na ipapaptay nya ako at marami pa sya death threat text messages sya akin, ipapasaksak ipapasagasa, at ipapatumba nya ako, dahil 5 thusand lang daw haga ng buhay k. lubos po ako nasaktan sa mag sinabi nya, nakaramdam po ako ng takot. ginawa po nya yun para dpo di ako mgasumbong sa pamilya nya. pero kailnman wala ako sinabi at nakipagusap sa khit kannio pamilya nya. ngyon po, ngfile ako sa NBI at prosecutor ng RA 9262 against him, pat ngyon lumabas na ang resolution, ng file sya ng motion for bail reduction at motion to appeal/review. insabi nya di daw dapat RA926 kc wala naman daw akong proof na nagkaroon kami ng relasyon. Attorny, paano ko po papatunayn? kasi medyo isnag taon na po yun ng huing may ngyari sa amin. sya lang p ang minahal ko sa boung buhay ko kaya sya lang angin ka relasyon ko. San po mtulungan nyo ako. [justify]

first, congratulations on getting a resolution in your favor. do you mean he filed an appeal at doj? well, if you don't have letters, emails, texts, pictures, then all you can offer is your testimony. what about testimony by your friends? you can also argue that is an evidentiary issue that is best resolved in a full blown trial.

anyway, the suspension of the proceedings is only 60 days. his arraignment should just be rescheduled.

thank you very much po. Ngyon po ngbail na sya. Pero august 9 pa po ang arraignment. Di ko po inexpect na ganun katagal. Worried po ako kc papunta syang Canada, sabi po sa kin hindi daw po akong mg file ng motion for Hold departure Order kc wala pa po sa arraignment. Sinubuka ko po na makiusap sa isang fiscal kaso wala po kasiguraduhan kung magagrant ang request namin na mapaaga ang hearing. Sana po may makatulong sa akin, ano po kaya nag maganda kung gawin. Takot po ako na matakasan nya ako.

yes po attorney, nagfile sya ng motion for appeal/review sa DOJ, pero wala pa po akong natatanggap na notice from DOJ,kasi sya lang po perosnally ang nagpadala sa akin ng copy.

under the doj rules, you have 15 days to respond after you receive his appeal. no need for the doj to send you a notice. you should prepare it now.

august??? grabe naman. proceedings are supposed to be suspended only for 60 days.

here is one tactic that you can use. get a certification from DOJ that the case is under review then file a request for issuance of a Watchlist Order at DOJ.

Oo nga po masyadong matagal, delaying tactics po ba nya yung mg motion for review sya? nakkaapekto po ba yun sa takbo ng kaso, sobrang hirap po napagdaanan ko at ganito po pala katagal.Attorney, sinasabi nya po pala sa counter-affidavit at sa motion for review na kiniquestion nya at denideny nya ngkaroon kami ng relasyon kc mabuti daw syang ama sa anak nya at mabuti sa asawa nya. How come na ngawa nya sa akin ito. ngyong niloko at ginamit nya lang ako. Dinidiin nya dun na may asawa na daw sya. Importante po ba na alamin ko kung talagang kasal sila ng ina ng anak nya kc ang alam ko lnag po live-in partner lang sila dahil hindi o apelyido nya ang gamit ng babae, ka-offcemate po kc ng isang friend ko yung babae, at confirm po na hindi nya apelyido ang gamit ng babae. Pwde po ba yung ganun na kahit kasal ka na pero maiden name pa rin mo ang gagamitin mo sa sa work mo. Importante po ba malaman ko na kung talagang kasal sila?Attorney, ano po proseso ng arraignment? ano po mangyayari pagktapos?

a motion for review is provided by rules of the doj, but the court rules state that suspension should only be for 60 days. perhaps it was not possible to get an earlier resetting or liberal si judge.

if you can, file a comment to his appeal at the doj. it is not necessary to prove whether he is really married. you can question it if he didn't provide a marriage certificate and say it isn't relevant anyway because you still had a previous romantic relationship.

arraignment is the step where the information or charge is read to the accused and he pleads guilty or not.

thank you. Attorney, pag ganito po ba na nasa family court ang kaso excluded po ang 9262 sa mediation? it wl be happened po ba before arraignment? I hope you don't mind po gusto ko lang po malaman ang pagkasunod sunod ng procedure. Im waiting po kc sa result ng motion namin, and later on po i wl talk to the fiscal na tumutulong sa akin. thank you po.

ra 9262 cases cannot be compromised so there is no mediation. in other cases, mediation happens after arraignment

hingi lang po sana ako ng opinyon sa asawa ko na nasa canada hindi po kasi kami kasal pero may dalawang anak po kami na sa kanya naka sunud ang pangalan ang problema po kasi may babae daw po sya duon at sya mismo ang nagsabi sakin. hindi na rin po nagpapadala ng allowance nga mga anak namin nauspital po yung panganay namin humingi po ako ng tulong pero wala po sya naibigay kundi ung philhealth na hindi rin po naayos paanu po ba ang tamang gawin sa kanya na kahit po sana sustento na lang ng anak namin magpadala sya kasi ang liliit pa po ng mga anak ko gustuhin ko man po magtrabaho wala naman po akong mapag iiwanan hindi ko rin po alam saan abogado ako lalapit wala po ako pang gastos hindi ko rin po alam kung madedemamnda ko sya dahil hindi kami kasal at nasa ibang bansa sya salamat po sana po matugunan nyo ang mga katanungan ko

you can first threaten him to send support or else you will file a complaint for economic abuse against him. you can also try writing to our philippine embassy where he is.

sa canadian embassy po ba dto ako sa pilipinas lalapit at mapapa deport po ba sya kung sakali man po na hindi sya tumugon sa mapag uusapan salamat po
