We left our father due to physical, psychological violence 21 years ago. Wala rin pong financial support nung time na yun. Ang mother at mother's side po namin ang tumulong samin sa lahat-lahat. As the oldest of the siblings, pinapirma ko po ang tatay ko 4 years ago na kung mabenta ang conjugal property ng parents ko, ang share po nya (tatay) ay paghahati-hatian naming magkakapatid. Meaning po, wala na syang share sa property.

1. May kasalanan po ba ang mga anak not to take care of their irresponsible father? Nakikipag-communicate po kasi samin ang side nya na dapat kami daw ang mag-alaga, hindi sila. Hindi po kami sang-ayon at 21 years na po namin syang di nakakasama.
2. Pwede po bang mapawalang-bisa ang pinirmahan nya? Pwede pa po ba syang magkaron ng share kahit may napagkasunduan na?

Legally, the spouse and descendants have the legal obligation to provide support.

If the waiver can be construed as a future donation to the children, then it can still be held to be valid, else such waiver is void.
