ano pong dapat ko pong action na gawin po? eto po talaga yung story bakit nagbigay ako ng resignation letter po..

last March po ay nag.ask ako na mag aabsent po ako by May 5 po sa principal namin and she said okay po.. But then po naka.absent po ako ng may 3 and 4 po due to some reasons po, eh nagalit po sya at sinabihan po ako na magreport sa school on May 5, but then hindi po ako nakareport kasi nasa ibang lugar po ako nun kaya bumalik po ako sa school May 10 (Tuesday) na po kasi holiday election day yung may 9.. pagbalik ko po ay sinabihan nya po ako na magbigay po ako ng resignation letter po by thursday, by then po hindi na po nya ako pina.duty.. Alam ko po na without due process yung pagteterminate nya po sa akin na may pinirmahan po ako na 3 years contract, kaya po pumunta po ako sa DOLE po para mag seek ng advice po, pero sinabihan po ako dun na magbigay nalang po ng resignation letter para dw good yung exit ko po dun. So nagbigay nalang po ako ng resignation May 12 po, tinanggap po ng principal but hindi po ako nabigyan ng any formal letter in response to my resignation letter po, sinabihan lang nya po ako na magbigay ako ng request letter para sa COE, service record at ibang papers po. So ginawa ko naman po, then wala na po silang binigay ng update mula noon, so nagtanong ako ng updates po para sa papers ko po through chat, then ganun na po yung reply ng principal na magbibigay po muna ako ng 20,000 po within 1 month for breaching the contract before nila ibibigay ang mga papers ko, paghindi po ay magrereklamo sila oh maybe magdedemanda sila against me po.  
ano pog dapat kung gawin dito po, in the first place po sila po yung nagsabi na magbibigay po ako ng resignation letter the bakit sisingilan ako ng 20,000 po without giving me any formal letter about it po then idedemanda po ako nila na walang kalaban laban po...
sanay matulungan nyo po ako salamat ng marami...

hi..ask lang sana ko ng advice, i have a training bond na worth 125k, kasi i was forced to go on a training  because i need a job wala akong choice. yun bond ko is not pro-rated. Tapos po, ito na ang problema, yun training na kinuha ko is wala ng silbe because yun client na pagagammitan nung training eh wala na sa amin so aanhin ko pa yun training na yun. My question is, pag nag resign ba ako kailangan ko pa bayaran yun? Gusto ko na kasi lumipat ng work kasi hindi na healthy un working envt ko. I hope you could help me. Gusto ko na kasi mag punta ng DOLE or NLRC...Sad

technically yes kelangan mong bayaran yun, if not pwede magdemanda yung employer to recover said amount. they have to convince the court na ganun ang ginastos nila sayo. hindi itong amount base sa pakinabang mo. pero parang ang laki naman ang amount. that being said if umabot sa korte pwedeng tumaas or bumaba yang amount. depende na sa korte na didinig sa reklamo

Ok..ang problema kasi e yun training is intended for a client kaso said client is wala na nga so what is the use of the training..tsaka the training will expire in 2 years pero the training bond is for 5 years na di naman nagamit..is that makatarungan para sa empleyado na pinilit lang?

again hindi tinitingnan kung "what is the use of the training?" Hindi mo pwedeng gamiting excuse yung pinilit. pumayag ka sa kasunduan kasi you wanted a job. unless you can prove na ni threaten ka or ni coerce into accepting the training and its conditions.

for example 1 year ka nang nagtratrabaho for abc company. abc now tells you, you need to undergo training and commit to pay if you dont stay with the company for 2 more years. if you dont accept this condition you will be terminated.

pag ganyang scrnario you can argue na pinilit kA.

yeah this is usually civil, they can charge you in criminal court is if they prove na merong fraud or malice involved. for example if they can prove na before ka pumirma, wala ka talagang planong tuparin yung kasunduan.

Ok again what i am trying to say is we do not have the client anymore, and that training will bind me until the very end even if we do not have the client anymore..i know what you are trying to say but i guess you are a promanagaement that has a purpose of demeaning their employees....thank you very much with your advice..may God bless you

Oo psychologically emotionally punilit ako..so you mean kahit anong training kahit walang sense kailangan i honor kasi pinag training ka.. kailangan sumunod kasi pinapasweldo ka..kapag di ka pumayag tatanggalin ka..tsk tsk..we have a stupid law here in our country..totoo na the poor are being oppressed by the rich here kasi wala silang choice kundi sumunod..i am just voicing out my concern..thank you mr.pro management

Ulitin ko lang ha, if ikaw ay empleyado na nila at pinilit ka, (tinakot kang mawawalan ng trabaho) pwede mo ireklamo yan. If mag apply ka palang and sinabi na sayo na yan ang condition na kelangan mong manatili sa trabho if hindi babayaran mo yung training. Kelangan talagang pangutan yan.

Again ultin ko lang, ang tinitingnan ng batas ay hindi kung gano ka beneficial sayo, ang tinitingnan po ay kung magkano ang ginastos ng companya para sa training. Wala po tayong magagawa at yan yung batas.
