Some advise please. Pumasok ako today upang mag resign at kumuha ng COE. Kelangan kasi dun sa lilipatan ko. Sabi ng HR since lilipat na daw ako saibang companya, mag resign daw ako. Pwede daw nila i-waive yung pag pasok ko ng 30 days after submission of resignation letter pero mag start palang sila mag process ng clearance ko is after 30 days. Pag katapos nun ay mga 30 days daw nila iprocess, after ma clea na ako, 30 days naman daw and makuha ko na yung tax refund, thirteenth month pay. Yung sahod daw pwede ko na kunin this saturday.

Hindi ba sobrang tagal naman nun. Kung ngayon araw ko ibigay yung resignation eh Oct. 13 ko pa makukuha yung COE? Ano po mapapayo nyo para mapadali?

Wala namang nakasaad sa batas na takdang panahon para sa ganyan - as long as it's within reasonable time.

Tama lang naman mag process sila ng clearance pagkatapos ng ilang araw o linggo para tingnan kung meron kang utang o bayarin.

follow up question. Ni absent nila ako nung July 5. May policy kasi dito na if hindi nag time in or time out para kaming hindi pumasok. Meron namang proof na pumasok ako dahil sa logbook ng security. Nalimutan ko kasi dahil sa pagmamadali ko dahil late na ako. dinahilan ko nalang na dahil fingerprint scan yung pang time in, baka hindi na register ng mabuti. Ang sabi sakin ng hr, company policy daw yun. May katwiran ba sila?

Tama lang sila kung ang basehan ng attendance ay ang fingerprint scan.

Tingnan mo kung merong katulad na sitwasyon na baka hindi nag-register ang daliri mo.

moderator
you can file a money claim at DOLE or NLRC for the lost day and they will determine whether that policy is reasonable even if you are able to prove that you were present
