Good morning atty,

hingi lng po ng advice pra sa sister ko. inaudit po ksi sya at nakitang may mg discrepancy yung payroll sheet vs alphalist ng bank transactions ng mga pinipayroll niya.. lahat ng payroll sheet na sinunmit niya eh edited na kaya talagang hindi na tugma karamihan ng payroll records niya sa mga tao... hindi din niya pinirmahan yung mga payroll sheets na ginawa niya ..lumalabas kasi na may atm siyang hawak pero di nkapangalan sa kanya at dun niya pinpasok..pero walang evidence na siya ung humhwak ng spare na atm na nkapangaln sa kumpnya..but still inamin niya ginawa niya from january to june na sinadya niya yung mga maling payroll.. umabot ng half million yung discrepancy .. nagmakaawa ang sister ko sa company na bbayaran niya yung amount na yun ibebenta niya ang kahit anong ibebenta..pero ang sagot ng may ari ayaw daw pumayag ng atty nila na hindi sampahan ng kaso ang sister ko... kahit anong pagmamakaawa ng sister ko yung atty ang ayaw pumayag na isettle na lang...buntis po sister ko running 8 months na. kaya talagang lahat ng paraan ng pagmamakaawa ginagawa na nila dahil nga sa natatakot makulong at buntis siya..kapag nanganak namn siya tapos ikukulong siya paano na daw baby niya..please atty help us po kung ano pong advice na mabibigay mo sa amin.

addition for my first message atty , may nagsabi po sa sister ko na ngmeeting daw po sa dati niyang pinpasukan na hindi daw matibay na evidence yung mga dokumento na nakuhanila s sister ko.. so until now naghhanap sila ng matibay na evidence.. sinsabi daw ng atty ng boss ng sister ko na pedeng sabhin daw sa korte na ginawa gawa lang yung mga dokumnto na nakuha nila kaya hindiparin maifile yung kaso against my sister.. my sister still keep on trying na mgmakaawa na isettle nangalang na babayaran nga niya pero atty na lang daw ng boss niya ang kauspin ng ate ko. hindi alam ng kabilanh kampo na nakarating na sa sister ko yung sinsabi na mahina yung dokumentong nkuha na nila para gawing evidence sa korte.. please atty paadvise po kung ano dapat gawinng sister ko..

What she should focus on is putting money together in order to settle, but the company has to also agree to a desistance. Indeed, proving a crime is not always easy. She can't prevent the company from filing a case, but she must be ready once they do.

ask lang po atty ang pag agree to a desistance kelan b ginagwa yun? once n nafile na ang case then nkipgsttle or kahit di pa nafile ang case then nagsettle n both parties?

no, only after the prosecutor has issued a resolution and the court issues a warrant of arrest

bale po may nagpunta daw na lalaki at taga NBI daw po sya dala ung letter or subpoena at sa august 1 daw dun magpapaliwanag sa NBI.ang ineexpect po kasi namin sa korte manggaling ung subpoena.nagyon po NBI po ang nagdla ..pinsan ho kasi ng may ari ng company yung isang NBI agent

they don't have to go to the prosecutor immediately. it is valid for them to go to the nbi first. in any case, it is an investigation; they will not have any authority to arrest her. send a representative and try to work out a settlement

ah bale atty pedeng magoffer ng settlement sa mismong Nbi kahit di magappear ang sister ko.. aftrr nya kasing natanggap ang subpoena naninigas na tyan nya at balakang niya sumsakit..epekto ng sobrang takot... pwede hu bang aswa nya ang magpupunta or need na ng atty sa PAO

pano atty kung di mkaattend ang sister ko kasi di p nman niya nabubuo ang half million ano ang mangyyari? at sinsabi din kasi mahina ung evidence nila.

if no settlement is reached, then the nbi will assess the case whether it should be filed at the prosecutor's office.

atty before nilang dinala sa nbi ang complaint lahat kasi ng pagmamakaawa at pakikipgsettle gingwa na...nung una kinkausp daw sila nung may ari-pero ung huling text ang sabi eh gusto daw talaga ng atty nila n ipush yung kaso..parang ang dating sa amin is ayaw na tlaga nilang makipagsettle. iimbistigahan daw ang sister ko sa nbi..takot n takot na siya kaya sabi namin sige wag na lang siya humarap kasi baka managank ng wala sa oras ...

Hi attyLLL, hingi lng po sana ako ng advice regarding sa live in partner ko. Kumuha po kasi siya ng pera sa trabaho niya ng paunti-unti hanggamg sa umabot sa more than ₱100,000. Inamin niya ung ginawa niya sa accounting nung napansin na nila na hindi niya idinedeposit yung mga liquidations dahil nga nagamit na niya. Hanngang sa pinatawag siya sa main office at pinaaamin siya habang nirerecord yung conversation nila ng abogado ng company. Binigyan din siya ng kopya ng mga discrepancy sa liquidation, kasama din dun sa ibinibintang sa kanya na unliquidated advances na hindi pa naman ibinabalik sa kanya yung sukli for liquidation. May mga ibinibintang din sa kanyang acknowlegement receipts, isa lng dun ung siya ang my pirma at yung iba ay sa nauna pa sa kanyang treasury staff, so hindi niya dapat kasalanan yun. Tinanggal din sa trabaho yung supervisor at assistant general manager ng company dahil sa kanya dahil sa hindi nila chinecheck yung mga liquidations at maling pamamahala sa subordinates at hinold yung sahod nila hanggat di pa niya nababayaran yung kinuha niya. Sumulat siya sa main office na hindi niya mababayaran agad yung nakuha niya pero humihingi siya ng time para makapagtrabaho sa ibang company at  paunti-unti niya itong babayaran ngunit ayaw nila at kakasuhan daw siya. Wala po kaming pangkuha ng abogado dahil wala po kaming trabaho. Ang tanong ko po ay ito:
1) ano po ang laban namin sa kaso?
2) may pupunta po bang pulis dito sa bahay para hulihin siya or padadalhan lng siya ng sulat?
3) maari po ba siyang kasuhan ng assistant general manager niya na natanggal din?
4) ano po ang pwede niyang gawin para hindi makulong at magbayad na lang ng paunti-unti?

if you want to limit risk immediately, i recommend he gets a loan to pay off the company so he will be dealing with just a debt rather than the risk of a criminal case.
