hi po. sana po matulungan ninyo ako. tumulong po ako sa friend ko na mareconstruct yung salary loan niya worth 19K 6 years ago na po ngayon na umabot sa 85k (2010) kaya nangailangan ng collateral at yung titulo ng lupa na nasa pangalan ng aking mga magulang na noon ay buhay pa ang aking ina. initially sinabi ng staff ng banko na hindi ipapasok kasi nga wala yung tunay na may ari then nagkaroon kami ng pinirmahan na papeles at pinapirmahan sa amin at kaibigan ko na nangutang at ako ay co maker kasi nakahiram din ako ng 5K. ang sabi nung manager ay magiging 18 - 22 months to pay more or less (5K monthly amortization)  pero nung ma approved ay 6 months lang at naproduce nila yung docs...nakabigay kami ng 15k noong unang month taliwas sa napag usapan na 5k dapat na monthly if 18 months. the second month 8k lang nabigay then 1k tapos wala na kc nawalan ng trabaho yung kaibigan q tapos kami naman ilang beses  nanakawan kasi walang kuryente at tao sa bahay...hanggang sa umabot na nga ng 500k ang utang pero binigyan kami ng "pag-asa" na kapag nakapagbigay kami ng 100k last year i eextend yung bayaran ng 5 years pa? ngayon po ay isasalin na sa bangko ang pag-aari kc me certification na at dumaan na sa BIR...wala pong na received na kahit isang notice...me ipinapakita na notice na nareceive nung kaibigan ko "daw" noong July 18, 2012 pero forged naman yung pirma ng nagreceived...ano po ang dapat kong gawin kasi patay na ang aking mga magulang...hindi alam ng aking mga kapatid na me mga sakit sa puso? hintayin ko po ang inyong kasagutan. nasa akin na po ang mga dokumento mula sa registry of deeds notation at ids or proof of signature ng aking ina. Sana po masagot ninyo ito agad kasi po pinapupunta na kami sa bangko within this week eh wala naman po kaming maibabayad sa kanina ng ganoong kalaki. Salamat po!

in whose name is the property? did they sign a real estate mortgage?

nasa pangalan po ng parents ko ung property pero yung loan or mortgage nasa pangalan lang ng inay ko kasi patay na ang tatay ko way back 2004 at walang document attached like death certificate ng tatay ko or ids ng nanay ko.

go to the sheriff under the clerk of court in the RTC where the property is located and try to look up the file of the auction of your property so you can be sure of the status.

Even after the title has been transferred, the bank will still need to file an action for the issuance of a writ of possession. that is the time you can question the auction if you can find a valid ground.

cge po gagawin ko po yan bukas...sabi po kasi ng manager ng bangko ay pirma na lang po ang kelangan para mapasakanila ung title eh kaya pinapupunta doon...pinalaki na po nila yung dpat naming bayarang down para mai extend pa ng 5 - 10 years.  in the first place po if sinunod nila yung pinag usapan namin e di matagal na pong bayad. sabi po nung kaibigan ko sa isang bangko napapakiusapan po naman yun kaya yun po yung gagawin namin sa Friday. For the 6 years po, di cla nakikinig sa pakiusap...para pong vested interest lang nila yung umiiral. Maraming salamat po sa pagsagot. God bless po! Smile
