sir ngkaroon kmi ng biglaang drugtest,pero fabricated ang dhilan nila,nlaman ko yon days later,un kasing bagong upong operation manager namin gustong patalsikin sa work ung supervisor which is ung ex-husband nya.na iginigiit na close q daw.few days later pinatwag aq sa office at bnigyan aq ng result galing sa testing center na aq dw ay possitive at memo to explain in handwritten,nkgwa po aq ngunit na late po sa date ng submission dhil tnmaan ng holyweek.pero ung letter q ay ngwa q within the date given to me.without any confirmatory test binabaan nila aq ng memo na aq ay terminated dhil aq ay possitive at failure to comply dw in ng written explanation.which i refuse to sign.tpos hinold nla shod q,pti trustfund q.lumipas ilang buwan di kona kinaya dhil tlgang wla ng png gastos nplitan aq pmirma ng quit claim pra mkuha pera q..pero i feel very violated.ngaun sir ano ba sa tingin ninyo,may habol pa po b aq ihabla employer q?

binabaan ako ng termination letter.pero hindi ko ito nilagdaan.mula nuon,inipit na nila ung sahod ko na natitira mula sa huling payroll,pati yung share ko sa savings.sabi nila pag pumirma ako ng quit claim makukuha kona sahod at share sa savings..isinasaad duon na ito daw ay cash inkind mula sa kumpanya at hindi na sila maaring ihabla pa..may habol pa po ba akong kasuhan sila sa ginawa nilang pang gigipit at pag terminate sakin kahit walang confirmary test ng drugtest?

The law is clear that drug tests shall be performed only by authorized drug testing centers. In this case, Sulpicio Lines failed to prove that S.M. Lazo Clinic is an accredited drug testing center. Sulpicio Lines did not even deny Nacagues allegation that S.M. Lazo Clinic was not accredited. Also, only a screening test was conducted to determine if Nacague was guilty of using illegal drugs. Sulpicio Lines did not confirm the positive result of the screening test with a confirmatory test. Sulpicio Lines failed to indubitably prove that Nacague was guilty of using illegal drugs amounting to serious misconduct and loss of trust and confidence. Sulpicio Lines failed to clearly show that it had a valid and legal cause for terminating Nacagues employment. When the alleged valid cause for the termination of employment is not clearly proven, as in this case, the law considers the matter a case of illegal dismissal.


Pero ang unique sa kasong ito ay nagpasariling drug test yung empleyado after 5 days noong nag-positive siya sa unang testing niya. Try mo na lang mag-reklamo.

ang termination letter ay hindi kelangan pirmahan para maging effective. wag ka pipirma ng quit claim if plano mong mag file ng complaint

you can still file your complaint. hopefully your quit claim was not notarized. it will be up to the company to prove that the drug test was conducted properly

Ang tagal na mula noong na-drugtest ka tsaka nag sign ka n ng quitclaim. Nde ka na papansinin ng amo mo. Force your employer to drug test you? Para saan? To get final pay? No need. To disprove na hindi ka positive? Ang tagal na e.


About the quitclaim. Pde pa dn magreklamo. Just make sure hindi pa lumilipas ng three 3 years.

Dagdagan ko lang pala yung doon sa na quote ko na kaso e nag-negative yung confirmatory test nung tao.
