Arresto Menor
Magandang umaga po.  May naiwan pong property ang aming tatay na nasa kanya pa pong pangalan ang nasabing property. Lima po  kaming heirs (mother at 4 na anak). Balak po naming ibenta pero hindi matuloy kasi ayaw pumirma ng isa kong kapatid sa extra judicial settlement dahil hindi naman daw siya interesadong ibenta ito.

Tanong

1.  Paano po mabebenta yung property ng  heirs na payag ibenta?

2.  Halimbawa po ay pumayag yung isa kong kapatid na ibenta na ay paano naman po ang hatian nun.  Me nabasa po kaming ganito sa deed of extrajudicial settlement of the estate.

THE PARTIES AGREE TO EQUALLY DIVIDE AND ADJUDICATE, AMONG THEMSELVES THE ABOVE DESCRIBED REAL PROPERTY.

me nakapagsabi sa amin na sa legal na hatian ay automatic na ang kalahati ng property ay sa surviving spouse agad at dun sa natirang kalahati ay may right pa din ang aking mother.  Gusto po naming sumunod sa legal na pamamaraan.  Tama po ba ito?

how did your father acquire the property? was it purchase, donation or was he an heir? did he buy it during the marriage with your mother or before?

If the sibling refuses, the remedy is court case of partition.
