Good day!

I need advice regarding sa house and lot na bibilhin po sana namin.Ang total contract price ng house na napagkasunduan is 1,280,000.00 nirequire kmi ni seller to pay 80k as down payment last June 15, 2016 then pwede na po kami lumipat kaagad sa bahay and the remaining balance na 1,200,000.00 babayaran namin sa kanila thru pag-ibig loan. Lately lang we found out na meron pa pala silang balance sa developer kaya hindi din po kami pwedeng lumipat sa house at si seller hindi din alam na kapag magloan kmi sa pag-ibig ng 1.2M ay wala na siyang makukuha dahil umabot din ng 1.2M ang babayaran pala nila sa pag-ibig. Ngayon sinisingil nila kami ng 1.5M para lang daw maibalik sa kanila kahit yung mga hulog nila sa pag-ibig. Sabi ko hindi pwede kasi yun ang napagkasunduan at yan lang ang kaya ng budget namin. Ngayon tanong ko lg po kung may right pa ba ako kunin sa kanila ang down payment ko? Baka meron po kayo dito sample letter na pwede kung gawin para obligahin sila na ibalik sa amin ang down payment. Ok lang sa amin na hindi na matuloy kahit medyo gumastos na rin kami sa pagrepair ng bahay as long as maibalik ang 80k. Nalaman ko rin sa seller na yung downpayment na binigay namin hinati hati na nila kasama yung dalawang agent kaya sinabi ni seller sa amin na pwede nya lang ibalik is 50k dahil hindi nmn daw napunta sa kanya ang 30k.

Well. Normaly aren't downpayments paid back,
but it can be demanded if the seller have BROKEN the contract. (Normaly NOT enough if there are just some delays.)
But if the seller have used agents that's HIS problem, so you are supposted to get back that part to IF you get back the down payment.
What does the contract say? Have they broken something important any much?
