Gusto ko sana magtanong about sa property namin sa bahay. I have a step-mother almost 9 years silang nagsama ng father ko, meron siyang 3 na anak with her first relationship, Hindi sila kasal sa unang relationship kaya nakapagpakasal sila ng father ko. Btw ang father ko is working abroad (KSA) almost 20years na, while my step-mother works as a supervisor in a private resort . Sa buong pagsasama nila nka afford sila ng mga appliances like aircon,ref,TVs at marami pang iba gamit using credit card ng step-mother ko na sabi ng father ko siya din nagbabayad ng credit card every month, name lang ng step-mother ko yung nkalagay pero father ko pa rin nagbabayad kasi nasa abroad sya. Then last July 2015 namatay ung step-mother ko dahil sa cervical cancer, hindi sila nagkaanak ng father ko. So bali father ko lahat gumastos from Hospital, Medicine, Operation dahil nagkaroon din ung step-mother ko ng mayoma, may mga utang din sila na hanggang ngayon father ko nagbabayad in short father ko lahat gumastos. Then after 1st year death anniversary ng step-mom ko ung 3 kids kasama ung real father nila hinihingi yung 1 TV and 1 aircon kasi dapat daw hati sila sa gamit ng father ko. Pero ayaw ibigay ng father ko kasi siya daw nagbabayad nun every month nung nabubuhay pa ung step-mom. Ang tanung ko po kung may chance makuha nung 3 bata ung 2 appliances kahit ayaw ng father ko kasi siya daw nagbabayad nun at hindi nya real na anak ung 3 bata. Salamat po

assuming there was no prenuptial agreement, then all their property acquired during the marriage was conjugal. her heirs were her children and your father so they cannot be excluded from inheriting whatever was in her estate, if any was left. So as to these assets, they do have some share in it, but unless you liquidate and properly partition her estate, no one can claim to be the sole owner of anything.

Yung 3 kids po ay hindi anak ng father ko sa step mom ko. Ung 3 kids ay anak nung unang naging karelasyon ng step mother ko pero hindi po cla kasal. Ang father ko po ang legal husband. Anu pong point para makuha ng 3 bata ang isang gamit kung hindi kaano ano ng father ko po sila. Ang father ko po lahat ng nagbayad nung appliances. Pede pong tagalog yumg reply. Salamat

Kahit na hindi anak ng father mo ung 3 kids ng stepmother mo ay may karaptan sila sa anumang pag-aari o assets ng kanilang mother na siyang step other mo, pero duon lang sa bahagi ng conjugal property nilang magasawa (father at stepmother mo). Anuman ung naipundar ng father at stepmother mo mula na ikasal sila ay conjugal property nila, puwera lang kung mayroon silang pre-nuptial agreement bago sila ikasal.  Nagtratrabaho naman ung stepmother o kahit hindi siya nagtrabaho basta't lahat ng naipundar nila ng father mo ay conjugal property.  Ung kakilala ko ay may 2 anak sa pagkadalaga bago napangasawa't pinakasalan ng asawa niya.  Nagkaanak sila ng isa at namatay ung asawa.  Ung lote't bahay nila pagkamatay ng asawa, nilikudate ng kakilala ko ung bahagi ng asawa nila sa ari-arian, kasi ang kamatayan ng asawa ay dissolve na ang marriage nila.  Ang extrajudicial settlement nila 1/2 na bahagi ng asawa ay binahagi sa 2 (anak nung namatay na asawa at sa kakilala ko bilang surviving spouse).  Ung 1/2 na bahagi ng kakilala ko at ung bahagi niya bilang surviving spouse ng asawa ay sa kanya.  Ung isang anak nila ay may karapatan pa rin duon sa 1/2 na bahagi ng kakilala ko kasama ung  2 anak niya sa pagkadalaga as illegitimate heirs niya.  Ayaw ng isang anak nilang magasawa na bigyang karapatan ung 2 anak sa pagkadalaga (hindi anak kasi ng tatay niya), kaya ung extrajudicial settlement ay sila lang mag-ina ang nagpartihan ayon sa Rule 74 ng New Rules of Court.  Nagpetition sa korte ung 2 anak ng kakilala ko pero na-deny sila dahil buhay pa ang nanay nila na siya lang ang may karapatan duon sa 1/2 ng asset nilang mag-asawa, subali't kung mamatay ang nanay nila, duon sila may karapatan sa 1/2 ng asset na nakapangalan na sa nanay nila.
