Condo dues charge while unit is not personally accepted.

Mawalang galang po sa lahat.. Mang hihingi po sana ako nang advice regarding sa Condo dues na na charge sa amin dahil na accept na raw namin yung unit. Me and my family are here in KSA dto po sila nag stay. Ang Storya po ay nag padala ang Land developer na pwede na raw namin accept ang unit at kung hindi kami mag papakita at automatic na accept na raw namin ang unit. May mga communication po kami at nung time na umiwi kami dun lang namin na accept ang unit and ispite of that may mga problema pa ang unit pero nung nag complain kami sabi nila out of warranty na kaya di na pwede ayus a the same time may pending kaming monthly Juice for almost a year eh wla naman sila pinapadala na nag chacharge na pala sila. Sa ngayun po nag kakainterest na yung condodues na hindi namin ma aaccept. Tapos ang sumasagot lang samin eh mga customer service na final na raw ang desisyun nang developer. SAmantalang nung nag complain kami before wal naman silang reply saamin.

Pwede po ba makahingi nang advice. SAlamat po and God bless,

Salamt po sa reply Sir,

Nagpadala mo sila nung letter dito sa amin sa abroad at na recived ko po yun last July 21, 2013.
Sabi po sa letter kung di kami mag respond auotomatic na accept na unit. Nag reply po kami sa kanila at ask ko po kung pwede yung brother in law ko na mag view para kung may problema at mag receive kung ok naman nabangit ko po kasi na sya yung SPA namin. dahil po andito kami sa labas nang bansa at hindi nila tinangap yung SPA na copy nang brother in-law ko medyo na delay po ang padala namin nag copy dahil nilakad namin dito sa Phil Embassy pero may communication parin naman kami nang developer, napdala namin yun SPA pero sabi nila na di nila ma accept dahil hindi pirmado sabi ko galing na nag nang embassy yun. Umuwi po wife ko last May 2014 at dun nya personal na accept yung unit. Kahit marami problema sa unit sabi nila out of wrranty na raw yun dahil accepted naraw lat 2013 pa. Di na po kami nakipagtalo dahil ayaw din namin masayang oras dahili limited lang po bakasyun namin. Napansin po namin na may condo dues na na naka charge mula nung nag padala sila letter. Ngayun po di namin binayaran yun gangang nag ka interest na pero nung mula na ma accept namin unit wal naman po kami palya sa monthly due.

Question: What does your contract provide?

Eto po ang dapat tingnan:
1. Contract
- usually sa mga preselling condos nakalagay na dapat ay bayaran ninyo ang dues kahit walang gumagamit basta meron ng turn over
- importante ang nakasaad sa contract

2. Condominium act
- liable po kayo sa condo dues kasi yan po ay kailangan para sa maintenance ng mga common areas

Sa tingin ko hindi na kailangan ng formal demand para kayo ang magiging liable. Kasi usually nakasaad yan sa contract.

Kung may hindi kayo pagkakaunawaan sa Developer pumunta kayo sa HLURB. Wala kayong makukuhang tamang legal advice dito kung walang kontratang nakikita.
