Tanong ko lang po, ang tita ko po na kapatid ng mama ko. Meron po silang namanang lupa galing sa kanilang ina. 4 po silang magkakapatid siya po ang gumastos sa pag subdivide sa lupa, bale hinati po sa apat sa tita ko 519 square meters. Sa panganay 648, sa natitirang 2 pa tag 649. Tita ko po ang gumastos sa lahat lahat nung na ospital at namatay ang lola ko pati libingan, kaya nung na subdivide ang ang lupa sa tita ko napunta ang lugar na bahay sa lola ko which is malapit sa kalsada, ang mga kapatid ng tita ko kasama ang mama ko nagbenta ng mga lupa nila.. ang problema ngayon nabalitaan namin na inaasikaso ng mga kapatid nya ang right of way na kukuhaan pa ang kanyang lupa ng 3 square meters. Tanong lang nya kung merong syang rights na hindi payagan na matuloy ang right of way. Pwera na lang kung bayaran sya sa makukuhang lugar sa right of way... bigyan lang kita ng history. Ang parte ng mama ko na 649 square meters ay sinangla nya sa bangko dati ng 500k, at muntikan ng ma imbargo dahil wala silang hulog hulog. Pero tinubos ng tita ko ng worth 800k nung 2012. Pero 4 years ang lumipas 150k lang ang binayad ng mama ko. Wala silang kasulatan, pero ina acknowledge naman ng mama ko yung utang nya. Ask din nya kung pwede sya mag demand ng payment bago nya approbahan ang rightway. Salamat hope to hear from you soon. Godbless and more power!

(My Tagalog is bad so I understood only some of what you wrote.)

In general right of way has to be given, normaly to the closest public road,
BUT against a compensation.

I don't know, but I SUPPOUSE such deals follow the LAND UNDEPENDING of who is owner (except perhaps when it's sold from family to strangers so they don't want the right of way be so CLOSE.)

Right of way cases are normaly handled by the Barangay Captain.

Thanks lunkan. But the property been sold to someone else. I dont think that the barangay captain have something to do with it.

I mean:

IF it is as for lease, then the right of way deal with the old owner follow the LAND UNDEPENDING of who is owner. But I don't know it's same for right of way.

It's Barangay Captain's work to try to solve such cases if you can'ẗ agree yourself with the new owner.

Good day. Magtanong lang po reg sa right of way. May gigrant po akong right of way para sa kapatid dahil nasa loob na ang property niya at dahil magapply siya sa pagibig housing loan requirement kasi ang ROW. So yong ROW was granted for free dahil kapatid. Ang nangyari after years my sister sold their property so iba na ang owner. Iyong new owner mayroon car at may car then ako dalawa. Dahil 2 ang car ko nakapark yong isa sa ROW. Nagalit ang new owner d daw dapat ipark ang car ko kasi  row at d daw sila makalabas lalot na sa gabi. Ang tanong ko tama ba ang ginawa nya na pagbawalan akong magpark? To think na ako ang owner sa lupa na naging ROW granted for free for them. Would like to ask my extent of rights since im the owner and tama ba sila na pagbawalan ako na magpark? At nangharass pa sila na ipullout immediately yong car namin. Please help. Thank you

Well. Someone have to give ROW to a close public road, and in your case probably you because there was a ROW deal allready.
BUT normaly for a compensation.

Is there a written ROW agreement?

In any case - if you can't reach an agreement, go to Barangay Captain to get it solved.

I don't know if it can be renegotiated because of it was sold to a not relative, but I guess NOT. Because it's written at the title, I suppouse it's seen as a part of the deal when the property was sold.

I don't know, but 2m is very narrow, many vehicles would get hard to get through, so I GUESS it would be hard to get such change.
