MAY katrabaho po akong kakapirma lang ng NYA probationary contract nya. yung contract nya po ay efFective hanggang nov 2016.
kaso nag apply po sya sa ibang company.. at interview nya po bukas.. tanong ko lang po.. kung matatanggap po ba sya sa pinag apply-an nyang bagong company.. tapos di na po sya pumasok sa present company nya.. ano po tawag dun??? breach of contract or AWOL.. or kung ano pa man po... ok lang po ba yung ginwa nya????

Nag AWOL sya kaya sya nag breach of contract. Pwede sya ihabla for damages nung current employer nya.

pwede syang mag-apply.

pwede nyang tanggapin ang bagong trabaho.

pero dapat magpaalam ng maayos - mag-file ng resignation, mag render ng kaukulang panahon (normally 30 days). Basahin ang kontrata kung meron syang babayarang multa kunsakali.

HINDI mo pwedeng pilitin ang tao na tapusin ang proby contract nya kung ayaw na niyang magtrabaho sa isang kumpanya. Ito ay 'INvoluntary Servitude" at ito ay labag sa batas.

Pwede siyang magresign at magrender at di tapusin yang proby contract niya at hindi mo puwedeng pigilan ito.

Good day.. gusto ko lang po humingi ng advise..

Nag work po ako home based and the reason why I decided to work at home kasi po I'm sick and my IM advised me to take a rest for awhile.. I do have a family and a 4 yr old kid to support so I decided to work home based.  Yung manager namin nag asked if who likes to work extra hours, wala po nag engage sa overtime.  What she did, she told us that is mandatory to work even its our rest day and very short po an notice.. I explained my side.. I told her that need ko mag rest kasi may Lab ako then she still insisted me to work on my rest day.  The next morning I messaged her that I decided to leave the job nalang since she told me din na i am not fit for the job.. Then I am asking if I can still get my salary..she said that hindi ko na daw makukuha un kasi nag AWOL ako...
I told her that I need the money for my medication but still hindi po sya nag rereply sa mga msgs ko even sa calls..sabi nya lang I cannot get my pay kasi nag AWOL daw po ako Sad

Pwede ko po ba ireklamo sa DOLE??? Kasi I'm sure hindi lang po ako ang employee nya na tinake for granted nya.. pinaghirapan at pinagpuyatan ko yung pagta trabaho ko sa knya and I even saw na yung hrs na pinag trabahuan ko ay na bill nya na sa client...

I don't think po na nagbabayad din sila ng taxes, grabe sila maka demand na hindi dapat ma late.. pasok namin 9:30 pero they want us be on ng 8:45.. tapos hindi lang pla nila kami babayaran.. grabe mga klaseng tao yan.

Dapat bang masunod ang art. 285 or kung ano ang nakalagay sa kontrata? Halimbawa, nakalagay sa kontrata namin na hindi kami pwede magresign hanggat di natatapos ang semester. Kung aalis kami kahit pa magrender ng resignation 30 days before ay di tatanggapin at magiging AWOL.

ahh salamat po.. ask ko lang po kung ano ano ang samples weird/wacky ways in which Psychometric Assessments were used in Recruitment/Hiring process.. kasi po HR kayo dba??

Hello po, last month po kasi na-regular na po ako sa trabaho after 1year probi.. Pero hanggang ngayon po wala pa po ako pinipirmahang contract. Halos mag-1month na po akong pumapasok na wala namang contract. Di pa rin po naddiscuss sa akin kung magkano increase ng salary ko. Ano po ang pwede kong gawin? Salamat po sa sasagot. Smile

I believe nasagot na ito sa ibang thread.

To add na lang. Di kailangan gumawa ng panibagong contract dahil kung 1-month ka ng pumapasok pagkatapos ng proby period mo at automatic na regular kna kahit walang kontrata. Hindi din obligadong magbigay o gumawa ang employer mo ng panibagong contract dahil sa mata ng batas ay regular ka na.

Hindi din ibig sabihin na kapag na-regular kana e meron ka ng salary increase. Maling pagiisip yan. Hindi obligadong magbigay ng increase ang employer kung naregular na ang employado. As long as lahat ng benefits mo ay maintained e walang problema.

Ang pwede mong gawin ay magtrabaho pa din dahil wala namang maling ginagawa ang employer mo.

Good day po..isa po ako staff nurse under 6mos probation.my pinirmahan po ako na 6mos probation contract and 3mos na po ako sa work ko and I decided po n mgresign..ngpasa ako.last aug 31 ng resignation so gang September 30 po ang effective ng resignation letter ko. My reason po kaya ako magresign is sumasakit na po ung wrist ko kasi 2 years ago my history ako ng dislocation. Bumalik ung pain sa wrist kosa kakabuhat ng payente kya ngpasa na po ako. Ngaun ayaw po ng superior ko pirmahan ung resignation letter ko? Consider pdn po ba na awol pg d ko n po pinasukan ung work ko khit ngbgay n po ako ng resignation letter ?

NO, hindi na considered as AWOL ang sitwasyon mo. As long as duly-received at nag-render ka ng 30 days. You are good.

Try to verify kung ano rason ng superior mo kung bakit ayaw niyang pirmahan resignation letter mo. Remember, isa sa karapatan mo bilang empleyado na magresign sa kahit anong rason.
