Single attached Subd - Improvements Violations

Hello po sa Property Lawyer and people with Real Estate background.

Nkakuha po kami ng single attached unit sa Subd sa Moldex Realty Inc(MRI) sa Cavite. Na pinaupahan namin at di nagtagal ay siya rin nakabili ng katabi naming house unit. Sa madaling salita, nag apply po sila house improvement habang nangungupahan sa amin ng mabili nila yung katabing bahay.

Hindi po pina alam sa amin  nag nagpapagawa sila ng bahay na 2 storey sa tabi lang namin, yung design ng bahay na pinatayo nila ay parang duplex type wherein fully occupied yung both sides ,  sinagad ang lote sa firewall namin.
At ang naging problema pa po ay lumampas sa firewall namin yung finishing at nosing ng pader nila. Ibig sabihin di na kami mkpagpataas ng firewall na pader namin at tinabunan nila yero namin nk overlap sa pader.
They took advantage habang pinatatayo nila yung bahay nila at gianagamit yung bubungan namin na tungtungan ,  kaya pala ayaw sa amin ipa alam.

Sumobra sila sa property namin as verified by city engineers office. Kaya problema po namin kung kami naman mag pa renovate dapat nila tanggalin iyong sobra na ayaw naman sumunod kung walang utos or legal order. Kahit pa nag file na kami formal complaint sa barangay uncooperative pa rin.

Ang tanong ko po, kung magfile kami ng demanda kasama ba sa complain ang MRI since single attached model unit lamang dapat ang itinatayo sa area namin. Sa kanila po nagpapa approve at kumukuha ng permit. Sila rin nag iinspeksyon habang construction phase pa lng ang nirerenovate na bahay. Pero na release construction bond na sa tingin mismo ng MRI ay may mali nga sa proseso pero hindi na sila hahawak ng complain kasi tapos na raw po ipatayo ang bahay. Ang MRI ayaw ng magbigay ng detalye paano narelease contruction bond at sino pumirma ng house design improvements though admit nila may mali nga raw.

Sa mga Single Attached unit subdivision di po ba dapat na may space  sa firewall namin bago ang bubong na katabi? Ano pananagutan ng realty developer gayong nakalusot magpatayo and isang nag apply ng house improvement/renovation.

Ngayon po perwisyo kami,  di namin mapa upahan ang bahay bawas income po sa amin....syempre na damage at degrade nila bubong namin habang pinatatayo yung pader ng bahay nila.

Need advise po sa single attached unit subd na may nagpagawa na duplex type... di po ba dapat mapanatili yung space from our firewall to the next  house unit?

yes, you can include moldex because construction permits are issued by the city engineer's office, not by a developer.
