i was abroad and lost my passport thus it took me sometime to come  back to pinas.so nangyari. i incurred 2 weeks
of absence but I have notified my supervisor about it.so pagbalik ko sa pinas, galit si sup at sinigawan ako in front of the my colleagues ( I have witnesses who signed an affidavit of what had happened). the supervisor B that time was asking for my supporting documents in regards to my absence and i was taking calls..parang napahiya ako at saka prior to that incident pinuntahan ko ung si sup A asking for what docs that they need. so nangyari ay sinabihan ako ni sup A at sabi ko cge bigay ko sayo..bumalik sa station at saka dumating na si sup B na galt at sinigawan ako..

then after that ng email si sup B about the issue then since medyo mainit na rin ako
naka reply ako ng "are you stupid, are nt you? sa email ng dahil jan the maangement consider na this is ground for termination kasi disprespectful daw..sabi ko rin if i was not being provoke by the sup, hindi ko yan gagawin at hindi namn ito nangyari dati

second, since i was absent for 15 days, they consider it abandoement pero sabi ko namn if i have abandoned my post why would i notify the management if were i was and what happened to me

so kaya tinerminate nila ako..question

1) serious misconduct and will ful disobedience - ask ko lang, can replying sa email "are you stupid, arent you" can be considered serious misconduct considering i was provoke din ng sup ko kaya nakapagreply ako ng ganun?

2) willful disobedience- prior to serving NTE, nag ask na ang sup ko ng documents pero i was waiting for formal documentation before i gave out my supporting document- in short, natagalan sila nang magserve ng NTE kaya ngwait lang din ako sa NTE before i gave my doc..will this be a willful disobedience?


3) 15 days AWOL- i have notified the management of what happened and iper compay policy, this only merit  final written kc though 15 days x, considered as one incident and this is my first violation. So can they term because of this ? abandonment?

Nagpakita ka ng affidavit na gawa sa ibang bansa?

How long were you out of the country in total? Saan ka pumunta at nawalan ng passport? Please provide specific dates so we can understand better.

Paano ka nakauwi?

1. They may have provoked you but you did say those things which may have offended them.

2. Nag ask na ang sup mo, so dapat binigay mo na. Parang doctor's certificate after an absence - don't wait for them to ask it from you - kusa mo nang ibigay.

3. AWOL ka ba talaga? Ano ang policy ninyo about advisement? Everyday ba dapat?

1.. YES, provoked or not, your action of sending those words can be a ground Termination because it is considered Serious Misconduct.

2. I suggest you wait for the NTE and explain in writing that you are just waiting for a formal document. Insubordination implies the existence of malice and intent. ASSUMING na totoo yang sinasabi mo, this is NOT insubordination.

However, superiors need to be given courtesy sometimes. If your supervisor REQUESTED (NOT ORDERED) that you submit certain docs, such must be done out of courtesy.

3. Council is correct. Check your Code of Conduct. If notifications are needed every day and you only made 1, the 14 other days are considered unauthorized. Also, look for the term "depending on the gravity of the offense". If such is included, one incident/instance can be sanctioned by Termination.

>>> kusa ko talagang binigay,as a matter of fact pinuntahan ko si Sup A ng ask ako kong anong docs ang gusto nila pero dumating si Sup B(under talaga ako ni sup B) pero ayon pinahiya ako, binigay ko ung copy one page lang ng passport ko....nang dahil sa incident na un, hinintay ko nalang na bigyan ng NTE at saka ako nagbigay ng docs na kelangan nila

>>>yes, the time i came back in the office, i coordinated with SUP A and even asked him what docs i need to submit at dumating si SUP B at nangyri ung pinahiya ako ..then that email in response ..reaction of what he did..so i decided to wait nalng sa NTE ko then after that I have given namn ng docs na kelangan nila..but the HR said that i should have given  the docs kahit walang NTE..hindi na daw ako naghintay pa ng NTE  bago binigay ung docs

So since nawala ang passport nung June 16, nagpa-rebook ka ng ticket before June 20?

Do you have proof na nagpa-rebook ka ng flight/ticket?

You have to show enough acceptable proof that your lost passport was the actual reason for the delay in coming home.

parang one way naman ang policy. the sup should have respected me, ....i know its wrong pero sa misconduct meron namn hindi considered serious at hindi serious pero i dont know why this is serious..sana sinuntok ko nalang ung sup ko..lol

So file a complaint against the supervisor.

Disrespect (and overall misconduct) generally gets worse for the employee when it is done to a supervisor or manager, or anyone in a higher position.

that is what i am compalining to them..kc the way i understand it, parang pinalabas talaga nila na serious ung ginawa ko at they did not consider na na provoke ako..coz if they will be fair to me, the sup could have been kicked out instead..second, the company is loosing and rumours has it that where about to closed down and im thinking also the company is making this issue big para materm ako at hindi mabyaran...

This is an example of an irrational and a twisted logic.

So if you get terminated, you are going to complain about the action of the Supervisor, is that it? And you are going to point out... "Why am i terminated but the Supervisor was reprimanded or suspended". I assume you're going to say "If i'm terminated, the supervisor should be terminated as well", right?

Well, is there's a sanction, you can't even question the action of the Management relative to the sanction of the supervisor, be it a suspension or reprimand because you have individual cases that CANNOT be compared. You just have to deal with your own action and the consequences of it.  Good Luck.
