Unfortunately:

1. While yung PS mo is from Sep 2 to Oct 2, na-supersede na iyon ng termination decision dated Sep 20.

2. Hindi nila kasalanan na natanggap mo ang notice after Oct 2. The fact is that they served the notice, and that it was done before the supposed end of your PS.

Mas lalo naman po siguro na wala ako kasalanan dun db? Besides isang bwan na nga ako nawalan ng income dahil hinihintay ko notice nila eh. What if nagfile ako ng case against them nang hindi q pa nrrceive yung sulat nila? Wala pa din akong habol?

dun sa pag send ng notice, hindi hinahanap kung sino ang may kasalan, just that na send yung notice or hindi. because na send nga nila on time wala silang liability in that regard

I believe nasagot ko na tong query mo sa ibang thread. Anyways, ulitin natin. Basta may Procedural and Substantial due process ay pwede ka matanggal. Tama ka, kung lagpas na sa 30 days ang preventive suspension mo at walang notice na galing sa management, pwede ka ng pumasok. Ang tanong, pumasok ka ba?

Kahit lagpas na ang preventive suspension ay wala na bang karapatan ang Management na magbigay ng desisyon? Of course, kailangan mag-desisyon sila. Basta documented at may basehan ang desisyon nila, sa mata ng batas, ito ay legal. Sa tingin mo dahil lumagpas na sa 30-day preventive suspension period ang kaso mo at wala ka pang natatanggap na desisyon, sa tingin mo ba ay lusot ka na at wala ka ng kasalanan?

Kahit ipadala ang desisyon sayo sa lagpas ng 30 days, kahit na pinadala sa mail, sa mata ng batas, ito ay pinadala sa araw mismo ng pagpapadala. Kahit na dumating pa sa iyo after 100 days ang mail, ito ay binding sa management sa araw ng pinaldahan.

tanong ko lang po. I was dismissed by my company right away for 3 NCNS (oct. 13,14 & 17). I then informed by Sup na magreresign and render 30days but my sup informed me that he recommended for my removal from our account. pagbalik ko ng 18, I was asked to sign 3 NTE's (first time ko pong magkaNTE since my 9months of work and within the 3 performance reviews I was rated with a 97-100% mark) and End of contract(btw, wala po kaming contract na nakuha from them just JO since the beginning kahit nung naregularized ako). As per HR po naprint na nila yung EOC ko, pero ako pa po nagtanong kung magkakaroon pa ba ako ng hearing prior to dismissal. ang sabi po sakin eh, right ko daw po yun. pero ilang ulit ko po sila tinetext to have it rescheduled kasi di ako pwede sa sinet nila na date- pero di nagrereply yung HR namin. 2x

question is: tama po ba na idismiss nila ako agad?

Unti unti ko na sana naiintindihan ang sasabi nyo. Eh ano naman po explanation nyo dito, nung Nov 1, nakareceive ako ng email from the office. Termination letter po pero s email nila, it is stated that i was terminated effective Oct 24.bigla na naman po ako naguluhan kase sulat na pinadala dto sa bahay, I was terminated effective Sept 20 but based on the email that I've just received, Oct 24.
