Hi Atty.,

We have one Female Engineer na nag text sa min sa HR regarding rude messages na received niya from a Technician na kasama niya din sa department niya.. Nag send sa kanya ng mga bastos na messages like pag hindi niya daw pinagbigyan yung guy sa gusto niya guguluhin cya at mga kabastusan pa. Yung messages na yun ay pinadala sa kanya thru text and private message sa Face book..

Si Female Engineer ay natakot at binolocked yung technician both facebook at phone.. Nung pinatawag nmin sa HR yung Technician sabi niya lasing daw cya nung time na yun at nagkamali cya ng send ng messages instead daw dun sa ex gf niya ay napadala niya dun kay Female Engineer kc magkasunod lang daw name nung girl at ni Female Engr. both sa FB at Phone. at nag ask cya ng forgiveness dun sa Female Engineer na ina-accept nmn po.

Now, kinausap po kmi nung pinaka head ng Engineering Dept. at sabi hindi daw nila ito-tolorate yung ginawa ni Technician kc harrassment yun both verbal and against violation against women. Nag bigay ng explanation letter na c technician at humihingi ng paumanhin. Hindi daw po enough yung ginawa ng HR para kausapin lang yung technician dapat daw sinuspend or termination.

Wala nmn po formal complaint c Female Engineer sa HR kaya kinausap lng po nmin and after nmin kausapin OK na po kay Female Engineer.

Tama po ba ginawa ng HR na kausapin lang c Technician at walang reprimand na ginawa? kc wala nmn fromal complaint c Female Engineer?

Si Female Engineer po ay mag reresign na effective oct. 14. ? Ok lang po ba na hingian nmin cya ng formal complain pra mabigyan ng suspension or termination c Technician?

Please advise po.

TAMA. Based sa kuwento mo, WALA namang formal written complaint o INcident Report man lang na may nangyaring insidentend ganito.

Ano ang aaktuhan ng HR kung walang documented incident? Kung wala e wala ding kailangan imbestigahan. HIndi naman pwedeng HR ang gumawa ng INcident Report o Written Complaint kasi sila mismo ang magiimbestiga. Ang labas nun ay HR na ang complainant at sila din magdedesisyon.

Is the email sent by the Female Engineer sa Head nila na mga exchanges of messages thru Private message sa FB and SMS is enough? Kc for us HR is not enough eh, importante is meron formal complaint

Is it proper to ask the Female Engineer to file a formal complaint so that we can do the administrative process para wala kmi maging legal issues later on at least before mag Oct. 14, kc nag file na ng resignation yung Female Engineer because of a better job offer sa ibang company.

DO take note that the incident is 'personal' to the offended party. And since it is personal, ONLY she can file a complaint because the Company is not involved in the matter.

With this, the email conversation can't be used by anyone (other than the female engineer) in filing a complaint in behalf of her, unless there is an authority from the latter.

It is NOT proper to ask the female engineer to file a formal complaint. You may only 'remind' her that she has the option to file a complaint BUT NOT to tell/ask/or force her file.

What do you mean by 'legal issues'? Do elaborate kasi madaming pwedeng ibig sabihin nito base sa insidenteng ito.
