I resigned in my company but I didn't finish my 30 days noticed period. Do I have the right to get certificate of employment eventhough I'm AWOL?

Ngpaclearance na po ako non ngresign ako pero hindi pumirma ung department manager ko. Lahat ay pumirma siyalang ang hindi. Before ako ngresign eh kinausap ko ung section manager namin at pumayag siya na kahit hindi ko na tapusin ung 30 days notice kasi wala naman ksming trabaho ng ilan months na. Crisis kasi nong time na un at ung mga contractual eh hindi na rin narenew kasi wala na work. Actually pabor sana sa company ko un kasi ngresign ako pero may mga taong pangit talaga ugali. Siya lang ang hindi pumirma sa clearance ko.

Kaya ko po tinatanong kung may karapatan po ba akong makakuha ng coe kahit awol ako. O kaya may legal basis po ba na pwede kong maging basehan para makuha ung coe ko?

AWOL o hindi, Terminated o hindi, lahat ng empleyado ay may karapatang kumuha ng COE.

sorry to barge in atty

pa help guys,
im working as a customer service rep here in cavite(bpo).i signed a contract that is per hour in nature, ang bayad literal na per hour kasi they are not paying for meetings bladder breaks and short breaks,talagang auto in lang ang bayad,ang mahirap pa they will force you to extend if hnd ka naka 8hrs,i escallted this to hr and the management pero napaginitan lang ako,last december they review all of my call at naghanap ng butas,they caught me dropping a call dahil ungas ang customer ko,i submitted an nte na wala ako pinirmahan na policy na bawal magdrop call which is totoo naman na wala at marami gumagawa nun including sups.nakalusot ako but next day sinuspend ako dahil sa q.a. score
65 out of 100.at that day madami kami bagsak some of us got 0 pero ako lang sinuspinde,naserve sakin ang suspension notice same day sarado pa ang hr.so went to dole and file a complaint,when the company heard it biglang nagpatawag ng hearing,i attended and stick to my statement na walang guidelines ang company since we didnt sign anything.nareinstate ako binayaran nila yung days na wala ako pero yung accured leave hindi,tapos ibinalik ako sa team ko na ang may hawak yung manager na inireklamo ko.after a month nagfile ako ng leave in accordance to our policy na pwd ka gumamit ng 10days leave all the time akala ko nakaleave ako and bayad,pagdating ng sweldo nagulat ako hinold daw nung manager kasi hindi na daw pwd yung policy na yun.nagreklamo na ko sa nlrc waiting for hearing nalang.


my question is:

1.illegal suspension tama ba?
2.reinstated sa same team?
3.retaliation article 118.
4.may habol ba kami sa work hours at ot?

Pumunta po ako sa office nila pero ayaw po ako bigyan ng coe kasi daw hindi ako ngcomply sa 30 days notice. Sabi ko naman eh kahit awol ako eh may rights ako na kumuha kasi naging empleyado ako sa office niyo. Ayaw makinig sakin talaga ung hr. Ano po ba next na gawin ko? Or may legal basis ba na pwede ko ipakita sa hr nila na pwede bigyan ang empleyado na awol ng coe?

Pwede kang magfile ng complaint, kasi lahat ng dismissed or terminated na employee ay may karapatan na humingi ng COE.
2 things that you should be careful about.
1. Meron na akong natanggap na COE from an applicant na nakasulat yung reason for termination is AWOL.
2. As far as i know although bawal ang hindi pag bigay ng COE hindi pa ata napasa ang batas kung anong time frame ka kelangan bigyan and kung ano ang penalty kung hindi sila mag issue
