We pay our taxes yearly, we discover that the parcel of land we owned ay nagkaroon na ng Transfer Cert. of Title without our knowledge, na public auction po yong bagong TCT na ginawang wala ng parcel dahil di daw nababayaran ng buwis, may habol pa po ba kami sa aming minanang lupa.

Which REASON do they say?

A; Foreclosed because of missing taxes?

B. Or someone else have claimed ownership? If so - related to you (distant) or what?

A. Foreclosed because of delinquent payment of taxes.
B. A deceased uncle of my mother was the one who transfer the title without our knowledge on 1977. According to DENR CENRO in Calaca, Batangas, we need to confirm in Land Registration Authority if the parcel of land owned by my mother which has a tax declaration was included in the title which was auctioned. Ang ipinagtataka po namin ay bakit patuloy kming nakakapagbayad ng buwis, nakakakuha ng tax declaration tapos lumalabas po na may ibang titulo na pala ang lupa at ang titulo nga pong iyon ang na auctioned dahil di ipinagbabayad ng buwis noon pang 2010. Dapat po ang titulo ay nahati sa 3 parcel, yong 1 parcela lng po ang alam naming di nakakapagbayad ng tax, nalaman lamang po namin sa Register of Deeds Tanauan, Batangas na na-auctioned na ang buong titulo. May pinanghahawakan po kaming resibo ng pagbabayad ng buwis

Oh. Both problems!

A. If it had been only this, then it would have been possible to solve if pay within a year from the property is sold.

B. This is complicated. Probably I don't know enough. Was the inheritance split made in an (Extra) juridical process?

A. Sir, nalaman lang po namin last month lang na auctioned iyong lupa pero 2010 pa po ang nakalagay ng makita namin at the back of title. Na auctioned po na di namin alam, without any notification, pero tuloy pa rin po kaming nakakapagbayad ng buwis.

B. May kanya kanya po kaming tax declaration, ask ko lang po kung paano nangyayaring nakakapagbayad pa ng buwis sa certain parcel of land na naibenta na pala, ayon po sa assessor lately ay kasama sa buong title na na auctioned ng gov't. , sino po kaya ang may negligence at di namin nalaman from the start na nauctioned na pala ang lupa which is na di kami papayag. Kung may notification lang po sana na dumating sa amin ay nagawan namin ng paraan para di mabenta sa iba..

A. IF if would have been ONLY type A, then it COULD have been solved by paying within a year,
BUT in this case type B complicate it.
So you need to hurry to try to solve B to not miss chance A.
But better tell buyer and others about this NOW too. Sad buyer wasn't told BEFORE the auction.

B. Such problems happen rather often, when inheritance spilts aren't done compleete with split OCT titles.
Sorry I don't know how to try to solve this best in the situation you are now.
