Ligal po ba sa batas na masama ang mga managerial position sa forced leave kung ang kumpanya po ay suspendido ang operation?kung ligal po,ano po ang basehan sa pagpili ng mga masasama sa forced leave?

pls be more specific. ano ang situation and gano katagal etc. madming klase kasing force leave. if "floating" status bec suspended ang operations then legal yan up to 6 months. after six months they have to pay you salary or separation pay

Force leave ng 3months then naextend ng 2months.pero may mga ibang employees po na marecall na after 3-4 months.kung legal po ang pagforce leave,ano po ang criteria para mapili sila.kasi maraming employees na naiwan sa company na di naman justifiable.at tsaka po,ibig sabihin kahit managerial position pwede po pala talaga masama sa force leave?

yes kahit anong position pwede. as long as yung position mo ay walang operation during that period, pwede ka ilagay sa floating status. basta wag lalampas ng 6 months

Thanks sir.ibig sabihin din ba kung suspended pa rin ang operation pwede po magrecall ang company ng piling tao lang?o kailangan pag nagrecall ay lahat na?sa case po kasi namin ay papabalikin ang ibang empleyado na regular at maghire po ng contractual,pero ang ibang managerial ay di pa pababalikin.legal pa ba iyon?

legal yung mamili sila kung sino but na mention mo nag new hire sila to replace the old ones? Medyo grey area yan but exact same position ba? Anong date nagsimula yung floating status?

August 22 po nagsimula ang force leave for 3months lang,pero dahil suspended pa po ang operation inextend po for another 2months. Bali ang balak po ng company ay irecall ang ibang empleyado para sa sub-activities ng operation.wala naman pong ihire na same position. Ang concern ko po kasi talaga ay kung ano po dapat basehan na matitira sa company at maforce leave.wala po kasing basehan ang pagkakapili na maforce leave ng ibang managers,at lalo na pong wala pong basehan ang mga natira sa company. Kung legal po talaga ang pag suspend,baka po sa pahpili ng tao ay may kakaiba.

company discretion yan. Unless it is blatantly discriminatory eg: there are 10 sales managers but ikaw lang ang ni "floating" status.

Actually sir,magkakaiba naman po ng positions.kaya lang po sa mga marerecall ay di po kasama ang managers na may involvement naman sa sub-activities ng operation.baka po may discriminatory na din na nangyayari.
