Please help.

I want to change my son's last name to mine. He is using my ex's surname. The father of the child signed the back portion of the birth certificate and had the affidavit notarized so that my son can use his last name. Unfortunately, we separated ways and I am planning to file cases against her mother and brother who inflicted me physical and emotional harm as well as to my child. My son is only 5 months old now. Can have my son use my last name? I am not after for any financial support. Please help!

does it mean that in the birth certificate it states that his last name is yours or the father's? if it is the father's, then you will have to file a petition in court, but there is no assurance it will be granted.
