1 AFFIDAVIT OF MARITAL SEPARATION on Thu Dec 29, 2016 5:40 pm

Arresto Menor
Hi everyone,

Currently I'm in a titling process of my late mom's house and lot. The property is under NHA and must be transferred under my name.

Im currently, but not legally separated from my estranged husband for almost 6 yrs.

Should I use my married name in the land title?

If yes, will it fall under our conjugal property? even if it is my hereditary from my mom?

NHA asked for my husband's signature in the deed of sale if I will use my married name. The problem is I dont know his whereabouts. I dont have any contact with him anymore.

I heard about the "affidavit of marital separation". Is it considered as a legal document? If yes, i assume that I dont need his signature in the deed of sale coz the property is my hereditary.

Hoping for your legal advises.

Thanks Smile
