Good day po! Gusto ko lang po malaman if unlawful yung changes na ginawa nang company (BPO/Call Center)  kung saan ako nag tatrabaho.

Nooong nag sign-up ako sa company naka indicate po sa contract ko that upon regularization I will be entitled to several items
1. night allowance (amount varies from 100 to 200 pesos depending on the start of the shift).
2. Perfect attendance incentive 4,500 pesos (quarterly payout)

mayroon din po silang binibigay na performance incentive (not in my contract)

Ito po ay part na nang practice nila before pa po ako ma-hire probably years before I was hired. morethan 2 years na po ako sa company.

Ito rin pong mga incentives and allowace na bigay nila ang reason kaya ko to tinanggap ang job offer nila.

Now, yung company po ay may binili na ibang call center at nasa process po sila na pag merge nung dalawang company. Yung mga existing na employees nung nabili na company they don't have the same benefits and incentives.

Nagkaroon po ngayon nang "Harmonization" wherein binawasan ang Night allowance namin, nawala ang attendance incentive, at na bawasan nang morethan 50% yung performance incentive. Then yung mga employees nung nabili na company nakaroon na rin sila nang performance incentive.

Sabi kasi nang HR namin yung mga incentives daw po ay "variables" at yung description po nila sa variables ay items na pwede baguhin nang company.
labag po ba sa Article 100 nang labor code yung ginawa nila?

the HR is correct and hindi labag sa batas to remove incentives, ang issue lang na nakukita ko is the fact that nakasulat ito sa employment contract. if pinangako na ng employer to entice you to seek employment with him pano nya ito tatanggalin. parang breach of contract ang result.
make sure lang to read the contract properly.

kung nasa contract hindi nila pwede tanggalin..

pag wala sa contract, and incentives, company's discretion yan.. so anytime pwede tanggalin or bawasan..
