good day!
if the parental advise is fake and the marriage license issued before three months, wala po bang bisa ang kasal o pwede itong maging ground for annulment?

Prision Correccional
Your marriage is still valid despite the fake parental advise and the marriage license having issued before the lapse of the three months period, please take note of Article 4, Paragraph 3 of the Family Code of the Philippines which states that:

“An irregularity in the formal requisites shall not affect the validity of the marriage but the party or parties responsible for the irregularity shall be civilly, criminally and administratively liable.”

The formal requisites of marriage are:

1. Authority of the Solemnizing Officer;
2. A valid marriage license except in the case of marriages exempt from the license requirement; and
3. Marriage ceremony which takes place with the appearance of the contracting parties before the solemnizing officer and their personal declaration that they take each other as husband and wife in the presence of not less than two witnesses of legal age.

Now, it is different story if the marriage license is also fake because in this case there is a total absence of a formal requisite which shall render the marriage VOID AB INITIO.
